Public procurement for supply of food products to a social care home in Poland
The input text concerns a Polish public procurement procedure conducted by Dom Pomocy Społecznej w Węgorzewie (Social Care Home in Węgorzewo, Poland) for the year 2027.
It is based on the Polish Public Procurement Law (Prawo zamówień publicznych – Pzp) and describes in detail the Specification of Contract Conditions (SWZ), annexes (draft contracts and forms) and electronic communication rules on the national e‑procurement platform.
The perspective is explicitly that of a Polish contracting authority applying Polish law, including references to Polish civil law, food safety law and EU food hygiene regulations.
The text specifies what bidders must submit and the minimum formal qualification requirements.
Such as: bidders must prepare their offer using interactive offer forms (formularz ofertowy) in Annex 1 (vegetables and fruit) and/or Annex 2 (eggs), in Polish, in electronic form, signed with a qualified, trusted or personal electronic signature.
Together with the offer, they must submit an exclusion self‑declaration under art. 125 Pzp using Annex 3, plus any necessary power of attorney where representation is not evident from registers (or for joint tenders).
Joint bidders must appoint a common representative and submit a statement indicating which supplies each will perform.
Where bidders use “solutions equivalent” to those specified, they must attach a list and description of these equivalents.
If trade secrets are claimed, they must be placed in a separate, marked file with justification.
Subject‑matter evidence is not required with the offer, but the best‑ranked bidder will be called, within at least 5 days, to submit an additional declaration on capital group affiliation (Annex 6).
There are no requirements for minimum turnover, references, or specific staffing; however, the draft contracts require the contractor to hold valid sanitary approvals or registrations from the State Sanitary Inspectorate throughout the contract period.
The scope of the contract is defined as cyclic deliveries of fresh vegetables and fruit and hen eggs of “Class I” quality to the Social Care Home in Węgorzewo.
Show all 39 statements
Such as: detailed assortments and estimated quantities are set out in Annex 1 and Annex 2, which serve both as technical specification and price sheet.
Deliveries must meet food quality and hygiene standards, including organoleptic properties and minimum remaining shelf life (at least half of the product’s total shelf‑life from delivery date).
Acceptance of goods for quantity and quality occurs at the delivery location; rejected items must be replaced at the contractor’s cost within a specified time.
The place of performance is explicitly the DPS in Węgorzewo; the contract performance period is from 01.01.2027 to 31.12.2027.
The contracting authority reserves the right to reduce volumes by up to 20% for each assortment (warzywa i owoce or jajka) according to needs, without the contractor having any claims, and to make quantity shifts between assortment positions provided the maximum contract value is not exceeded.
Award criteria and their weighting are simple and strictly price‑based.
Such as: the only criterion is “Cena” (price) with a weight of 100 points.
The scoring formula is C = (CN/CR) × 100, where CN is the lowest gross price offered and CR is the gross price of the offer assessed.
Only non‑rejected offers are evaluated; the highest‑scoring offer wins.
In case of a tie (same points), the authority will invite those bidders to submit additional offers with new prices, which cannot be higher than those previously offered.
There are no qualitative criteria (e.g. delivery time, quality system, experience) and no negotiations; the procedure is the “basic” mode under art. 275(1) Pzp without negotiation.
Risks and special conditions are mainly addressed through contract clauses, not through financial guarantees.
Such as: no bid bond (wadium) and no performance security are required.
However, the contracts impose contractual penalties: 50 PLN gross for each started hour of delay in delivery, limited to 2,000 PLN per delay; 100 PLN gross for each undelivered assortment item; 100 PLN gross for each case of non‑compliant or poor‑quality goods (not current production, lacking required certificates, not meeting food law or standards).
If the contract is terminated due to contractor fault, the authority may charge a penalty equal to 5% of the maximum gross contract value, and total penalties are capped at 15% of the gross remuneration, without prejudice to general damage claims under the Civil Code.
The authority may also commission substitute performance (delivery by another supplier) at the contractor’s cost and risk after a failed cure notice.
The contracting authority can reduce quantities by up to 20% and may withdraw from the contract in case of unforeseeable changes affecting public interest (e.g. closure of the care home).
There is price indexation (waloryzacja) once during the contract term, based on GUS consumer price indices for “Food and non‑alcoholic beverages”, limited to 10% of the remuneration and applicable only to the unrealized portion.
Subcontracting is allowed without restrictions, but the bidder must indicate in its offer which parts will be subcontracted and, before performance, provide names and contacts of subcontractors and update this information during performance.
The bid validity (termin związania ofertą) runs until 03.12.2026, with possible one‑time extension by up to 30 days upon written consent.
Questions on SWZ must be submitted via the Platform at least 4 days before the bid deadline (03.11.2026, 08:00); answers are provided no later than 2 days before the deadline.
No site visit is mandatory, and no advance payments or cost reimbursement are foreseen.
Such as: the SWZ, together with its annexes, is the primary specification, and where matters are not regulated therein, the Public Procurement Law and implementing acts apply.
The draft contracts (Annexes 4 and 5) explicitly state that issues not regulated in the contract are governed by Pzp and the Civil Code.
Adjustments to the SWZ content may be made before the bid deadline, with changes and explanations published on the e‑Zamówienia platform; such published changes modify the applicable conditions.
There are references to “pieczywo” (bread) in penalty clauses, which appear inconsistent with the subject (vegetables, fruit, eggs) and likely stem from a template reused from another contract; in practice, the binding scope is defined by §1 of each draft contract and Annex 1 thereto (warzywa i owoce or jaja kurze), so penalties should be interpreted in relation to the actual subject‑matter as described there.
Where the documents state that quantity reductions relate to “warzywa i owoce” versus “jaj kurzych”, each draft contract contains its specific 20% reduction clause aligned to its respective SWZ annex, and those specific clauses apply to the relevant lot.
Only the contracting authority's tender documents are binding. As of: 26/10/2026
