Servicio de dirección de obra para sustitución de cubierta con amianto en Sant Lluís (Menorca)

The input text concerns a Spanish public procurement procedure launched by the Ajuntament de Sant Lluís (Balears, Spain) for a service contract of “dirección de obra” linked to construction works to remove and substitute an asbestos roof on the cooperative’s nave.

The country context and legal framework are clearly Spanish, with references to national legislation (Ley 9/2017 de Contratos del Sector Público, Código Técnico de la Edificación, Ley 38/1999 de Ordenación de la Edificación, etc.) and EU directives only as transposed into Spanish law.

The background of the documents shows, on the one hand, the technical construction project (“Proyecto básico y de ejecución para adecuación y sustitución de cubierta”) and, on the other hand, the contracting authority’s administrative and technical notes for the service of site supervision.

As such, the project text describes in detail the regulatory compliance of the future works (for example, with CTE DB-SE, DB-HS, DB-HE, RD 396/2006 on asbestos, RD 105/2008 on construction waste) and sets out the three‑month execution period for the works and obligations like the plan de calidad and CE certificates for materials.

The procurement notes define the separate service contract for the architect/engineer responsible for directing the works, with value about 4,300 € (without VAT), CPV 71240000, procedure abierto simplificado and several award criteria.

Regarding what the bidder must submit and minimum qualification, the text indicates that offers are presented electronically via PLACSP in a single envelope (“sobre único”) containing documentation administrativa and the automatically quantifiable criteria.

There is no requirement for contractor classification for this service contract; classification is explicitly stated as “No és d'aplicació” for services, and the works project also notes that classification is not required because the works’ value is <500.000 €.

On the scope of the contract (what, how much, where, when), the object is the “Servicio de dirección de obra de las obras de sustitución y retirada de la cubierta de amianto de la nave de la cooperativa de Sant Lluís”.

As such, the successful bidder will carry out tasks such as direction of obra, reception of the works, and the report for the return of the works guarantee, for construction works that include removal of asbestos roofing, installation of a new roof system, and related electrical efficiency improvements (renewal of the main electrical panel and replacement of luminaires by LED “campanas”).

The place of performance is Sant Lluís, island of Menorca (subentidad territorial ES533), Spain.

In terms of period, the PLACSP data specify a contract execution period of 15 months, with the observation that the direction of works starts with the signing of the Acta de comprobación y replanteo and ends with the end of the works’ guarantee period; the actual works are estimated to last 3 months from that acta.

Show all 27 statements

The project itself states “El Plazo para la Ejecución del Proyecto es de 3 meses” for the construction works, and points to a subsequent guarantee period (detailed in the pliego de condiciones generales, with clauses on plazo de garantía, prórroga del plazo de garantía, conservación de las obras, recepción definitiva, etc.).

As for award criteria and weighting, the procedure is open simplified with “diversos criteris d’adjudicació” that are quantifiable through formulae.

Specifically, there are two criteria: (i) price, up to 40 points, using the formula “Puntuació = 40 × (preu licitació – oferta sol·licitant)/(preu licitació – oferta més baixa)”; and (ii) quality, up to 60 points, based on professional experience in similar site supervision contracts.

Such as, 15 points are awarded for each contract of direction of works executed in the last 10 years of equal or similar nature for a public administration (excluding the last 3 years), and 10 points per similar contract for a private promoter (also excluding the last 3 years).

The documents elaborate what counts as “treballs d’igual o similar naturalesa”: direction of works for replacement/renovation/rehabilitation of roofs, new roofs of similar typology (lightweight roofs, sandwich panels, profiled sheet, deck roofs, metal/wood/concrete structures for large spans), works including asbestos removal or fibrociment, and reinforcement/consolidation/repair of roof structures (trusses, beams, purlins, supports).

The quality criteria thus represent at least 51% of the total scoring, in line with LCSP for intellectual services.

In terms of risks and special conditions, the contract requires a definitive guarantee of 5% of the award amount, as indicated in the PLACSP summary (“Garantía Requerida Definitiva Porcentaje 5%”).

There is a strict prohibition on subcontracting: “El contractista no pot concertar amb tercers la realització parcial de la prestació” and “Subcontratación permitida: No se permite la subcontratación”.

The insurance requirement described above is a key risk‑mitigation tool, and the works project further points to obligations under the plan de calidad, e.g. the contractor executing the works must provide CE certificates for materials, technical data sheets, etc., all to be accepted by the dirección facultativa prior to entry to site.

Such as, the project pliego de condiciones generales contains clauses on ritmo de ejecución, reclamaciones contra órdenes de la dirección facultativa, trabajos defectuosos, vicios ocultos, limpieza de las obras, documentación final de la obra, conservación de la obra, seguro de las obras, and prórroga del plazo de garantía, but the snippet does not reproduce explicit penalty formulas or the exact validity period of offers, nor does it mention a site visit or deadline for bidders’ questions.

It is, however, clear that compliance with Spanish health and safety norms, especially for asbestos (RD 396/2006, prevention of risks law 31/1995, and international conventions), and with waste management norms (RD 105/2008, Ley 7/2022), will be crucial in the works that the awarded director will supervise.

On contradictions or clarifications between documents, there are minor differences in wording regarding the end of the service period: the need report states the direction of works finishes with “recepció i liquidació de les obres”, whereas the PLACSP announcement states that it finishes with “la finalización del plazo de garantía”; given the PLACSP pliegos are formally part of the tender and explicitly linked to the 15‑month contract period, that latter wording is likely to govern the contractual execution period for the services.

Similarly, the construction project specifies an execution period of 3 months for the works and declares price revision formulas unnecessary due to a duration under one year; the PLACSP summary also notes 3 months estimated for works, which is consistent.

There is no contradiction on classification requirements: the services contract confirms that contractor classification is not applicable, and the works project clarifies that for works under 500.000 € classification is not required.

In the absence of full text of the Pliego de cláusulas administrativas, where detailed penalties, validity of offers, and other conditions would normally be set, the statements in the PLACSP tender notice and the INF‑046‑26 report should be treated as the operative ones for bidders preparing their offers.

This procedure allows 15 days between publication and deadline — typical in this country is 26 (median of 7,730 procedures). Much tighter than usual: the first week counts.

Foreign bidders

In Spain · Architecture & engineering, 153 contracts went to foreign companies over the last 3 years (of 40,376 recorded awards) — mostly from France, Germany, Italy.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
