Contract for construction of a park and sports court in La Viñuela (Benalmádena)
The input text concerns a Spanish public works tender published by the Ayuntamiento de Benalmádena (Spain) for the “Obra del Parque infantil y pista polideportiva en la Viñuela, en calle Rambla, en el Término Municipal de Benalmádena”.
The point of view is the Spanish contracting authority under the Spanish Ley 9/2017 de Contratos del Sector Público (LCSP) and EU Directiva 2014/24/UE, with procedures and requirements framed by Spanish public procurement law.
No other countries than Spain are mentioned.
The scope of the contract is described as the construction and acondicionamiento of a municipal green plot (zona verde V3 del PA-SUC/SP-11 La Viñuela) to create a children’s playground and a multi‑sport court.
Such as explained in the justification of need, the works aim to provide leisure and sports facilities for the urbanization.
The total municipal plot is 7,469 m², but only an area of 2,436,03 m² with more favourable topography will be acted upon; the rest has steep slopes and is practically unusable.
The place of performance is Benalmádena (Málaga, ES617) with precise ETRS89 UTM coordinates referenced (point 1: X 360010.124, Y 4,050,595.714).
The estimated value of the contract is 495,696.42 EUR, with a base budget of 599,792.67 EUR (495,696.42 EUR before taxes).
The execution period is 180 calendar days from the replanteo act, or a shorter period offered by the contractor, with no contractual extensions (no prórrogas) foreseen.
Regarding what bidders must submit and minimum qualification requirements, the procedure is “procedimiento abierto simplificado” under article 159 LCSP, with a single electronic envelope (“Sobre A: Único”) containing administrative documentation and automatically quantifiable criteria.
Such as listed under “Condiciones de admisión”, bidders must prove: capacity to contract (“capacidad de obrar”), absence of prohibitions to contract and incompatibilities, compliance with Social Security and tax obligations, prior registration in ROLECE (and declaration of no data changes), and, for foreign companies, submission to Spanish law (all “Conforme Anexo 2 del PCAP”).
Technical-professional solvency (“Criterio de Solvencia Técnica-Profesional”) is demonstrated by a list of works executed in the last five years, supported by certificates of good execution; the accumulated annual amount in the year of greatest execution must reach at least 70% of the estimated contract value (≥ 346,987.49 EUR).
Show all 29 statements
For newly created companies, academic and professional titles of the entrepreneur, directors and responsible technicians must be provided.
Economic-financial solvency requires an annual turnover in the best of the last three financial years of at least 1.5 times the estimated contract value (≥ 743,544.63 EUR).
Such as repeatedly indicated, bidders holding a works contractor classification certificate GRUPO G, SUBGRUPO 6, CATEGORÍA 3 (or equivalent) from the Junta Consultiva de Contratación Administrativa are exempt from separately submitting the detailed solvency documentation.
On award criteria and weighting, the procedure uses three criteria evaluable by formulas, all included within the unique envelope because no subjective (judgement) criteria are used.
Such as set out with their weights: (1) “MEJORA EN EL PRECIO” (price improvement) – 90 points; any offer equal to the base budget gets 0 points and scoring follows the formula PI = (PL - PE) x PM / (PL - PV) (with PL, PE, PV, PM defined in PCAP Annex 9); (2) “MEJORA EN EL PLAZO” (execution period improvement) – 5 points, with formula PI = (PL - PE) x PM / (PL - PV) and a minimum execution period threshold of 160 days, below which no further scoring advantage is obtained; (3) “MEJORA PLAZO DE GARANTÍA” (extended warranty period) – 5 points, with formula PI = (PE - PL) x PM / (PV - PL), expressed in years of extension of the contractual guarantee.
The validity period of offers is 2 months.
The tender is not a subasta electrónica (explicitly “Se adjudicará mediante subasta electrónica: No”), despite the platform heading “Subasta electrónica” in the notice.
On risks and special conditions, the documents state a definitive performance guarantee of 5% of the contract price to be constituted within 7 days after award.
Such as mentioned under “Condiciones especiales de ejecución”, there are environmental considerations (Anexo 1.N and Anexo 11), and no price revision formula applies (Anexo 1.J PCAP).
The contract will allow electronic invoicing and payment but not electronic purchase orders.
Subcontracting is allowed pursuant to article 215 LCSP and Anexo 1.S PCAP, and no critical tasks are reserved to the main contractor.
Prórrogas (extensions) are explicitly excluded.
The deadline for submission of tenders is 20 calendar days from the day after publication in the contracting profile (here concretely until 10/11/2026 at 23:59), with opening of the administrative envelope scheduled around 11/11/2026 at 10:00 in a private session; any questions or requests for clarification must be channelled through the contracting authority indicated (Concejalía de Hacienda) and PLACSP, although a specific “question deadline” is not quoted in the extracted text.
Risks of exclusion arise exclusively from national grounds as per article 71 LCSP and PCAP clauses 8 and 12 and Annexes 2 and 14. Remedies include a reposición appeal as per clause 36 PCAP, filed within one month, or contentious-administrative proceedings within two months.
Such as clarified in the decree of aprobación and the resolution of inicio, both refer to the same expediente 2026/53673Y.
There is also a non‑substantive duplication of notices in PLACSP (two timestamps on 21‑10‑2026 at 14:11 and 14:18), but they share the same data (procedure, dates, criteria), and no conflicting deadlines or conditions appear: the binding time limits are those concretely stated for tender submission (10/11/2026) and resources (21/11/2026), “conforme Anexo 1.U” and clause 36 PCAP.
In case of any residual inconsistency, the hierarchy under Spanish law would make the PCAP and PPT (and their annexes) prevail over summary platform fields, so the detailed annex references (Anexo 1, 2, 4, 8, 9, 11, 14) are the applicable statements.
Only the contracting authority's tender documents are binding. As of: 23/10/2026
