Clement What the numbers say about this buyer

  • In this sector the buyer awards roughly every 4 months (27 awards, most recently August 2026) — the next award is due around December 2026 by that rhythm. The last award went to INMEX MENORCA 2023, S.L.n = 27
  • 35% of this buyer's awards went to companies that had already won here before (125 awards since 2020, spread over 79 companies). That is well below the sector norm (52%) — this buyer switches suppliers more often than others.n = 125 awards since 2020
  • The median procedure drew just one bid (8 procedures with a bid count); 50% ended with a single bidder. Sector: median 3 bids.n = 8
  • 93% of the bids received came from small and medium-sized enterprises (9 procedures with a bid mix). Sector: 68%.n = 9
  • The award came in at a median 90% of the estimated value (110 awards with both estimate and value) — pricing at the estimate is usually too high here. Sector: 90%.n = 110

Contract for partial asphalt renovation in Cap d'en Font (Sant Lluís)

The input text concerns a public works contract promoted by the Ajuntament de Sant Lluís (Spain), specifically for partial renovation of asphalt and road markings in the urbanization of Cap d'en Font, Menorca (ES533).

It is framed in Spanish public procurement law (Ley 9/2017 de Contratos del Sector Público, LCSP) and local Balearic regulations (e.g.

Llei 8/2017 de accessibilitat, Llei 1/2020 ambiental, Decret 59/1994), so the country point of view is clearly Spanish, with references to EU directives and CE marking of construction products.

As background, the documents include: the reasoned necessity report, the basic and execution project (memòria, plecs de condicions, plans, budget), the quality control plan, and the procurement notice in the Plataforma de Contratación del Sector Público (PLACSP).

These texts explain that the existing asphalt is deteriorated due to traffic and weather, and that the municipality intends to restore road safety and durability by hiring a specialized construction firm via an open simplified procedure with a single award criterion (price).

Regarding what the bidder must submit and minimum qualification requirements, the texts indicate that offers are presented electronically through PLACSP in a single envelope containing administrative documentation and the price offer.

While the detailed list is in the “Pliego de cláusulas administrativas” (referenced but not transcribed), the notice and the reasoned report specify: capacity to contract and absence of prohibitions (clause 12 of the administrative pliego); compliance with tax and Social Security obligations; economic-financial solvency via minimum annual turnover of 216,495.66 € (1.5 times the estimated contract value, per LCSP art. 87, calculated on the best of the last three completed years); technical-professional solvency via a list of works executed in the last five years with good execution certificates, with an annual executed amount in the best year at least 70% of the estimated value (101,031.31 €, per art. 88 LCSP).

For new companies (<5 years), solvency must be proved by other means in art. 88 b–f LCSP.

Additionally, during execution suppliers must provide origin and delivery documents, manufacturer guarantees, and CE marking/conformity documentation for construction products, as detailed in the quality control plan with exhaustive lists of product types and applicable UNE-EN standards.

As for the scope of the contract (what, how much, where, when), the object is “Obras de renovación parcial d’asfaltat a la zona de Cap d’en Font”, at C/ d’Es Caló Blanc and C/ de Ses Anglades.

The project describes, for example, execution of a new hot asphalt wearing course (aglomerat asfàltic en calent) over 2,640.00 m², with prior milling (6 cm in Es Caló Blanc and 2 cm in Ses Anglades), application of adhesion coat (emulsión aniònica ECR-2 at 0.7 kg/m²), and renewal of horizontal road markings, including tactile pavements adaptation to Llei 8/2017.

The estimated value / base bid amount without VAT is 144,330.44 €, plus 21% VAT (30,309.39 €), totaling 174,639.83 €.

Show all 26 statements

The execution period is set at 3 weeks / 21 days from the signing of the acta de comprobación y replanteo.

The place of performance is Cap d’en Font (Menorca, ES533), with no lot division, justified because splitting would hinder coordination and technical consistency.

Concerning award criteria and weighting, the procedure is open simplified (procedimiento abierto simplificado) under art. 159 LCSP, with a single criterion: price.

The municipality explicitly states that, given the clearly defined nature of the asphalt and paint works in the basic/execution project, no improvements are foreseen or valued.

The formula for scoring offers is: Puntuación = 100 × (precio de licitación – oferta licitante) / (precio de licitación – oferta más baja), taking prices without VAT and including all cost components.

Thus, the cheapest offer receives 100 points and others are scored proportionally; no qualitative or multi-criteria evaluation is envisaged, and there is no electronic auction.

On risks and special conditions, the documents mention: definitive guarantee of 5% of the final offered price excluding VAT, to be provided by the best bidders (art. 107 LCSP); no price revision because the execution period is under one year; insurance obligations for the works, guarantees for material damage due to construction defects, and conservation duties, all contained in the administrative “plec” (index references to sections on fiances, insurance, guarantees, economic provisions and mutual indemnities).

Subcontracting is expressly allowed on a partial basis, since the contract is not secret nor reserved, requires no special security measures, and contains no critical tasks (art. 215.2.d LCSP); coordinated subcontracting is considered not detrimental to execution or deadlines.

The quality control plan requires following the basic safety and health study and having the contractor prepare a detailed safety plan.

Environmental impact assessment is not required per Llei 1/2020, and the CTE is generally not mandatory for this project because no buildings are affected, although Decret 59/1994 quality requirements and CE-mark rules still apply.

The notice sets the offer submission deadline (11/11/2026 at 23:59) and opening event (12/11/2026 at 10:30), but there is no mention of a compulsory site visit or a specific bidder question deadline beyond the general PLACSP information access period.

As to contradictions or corrections between documents, the main potential discrepancy is the expression of the execution period as “3 semanas” versus “21 días”; these are equivalent and consistently tied to the acta de comprobación y replanteo, so no substantive conflict exists.

Another apparent tension is that the memòria states the CTE is not of obligatory compliance for this project, yet the quality control plan is structured “Para dar cumplimiento a lo indicado en el Art. 7, punto 4 (CTE parte I)” and annexes extensive CE marking requirements; this is resolved by the clarification that Decret 59/1994 and the applicable Dbs still impose material-quality obligations even where the CTE’s building-focused parts are not strictly mandatory.

Finally, while classification of contractors is not required because the contract value is below 500,000 €, the report still assigns a theoretical classification category (Group G, sub-group 4, category 1) as reference; the legally operative statement is that classification is “NO exigible”, so lack of formal classification cannot be used to exclude bidders.
