Contract for road safety improvement works on E.P. 3303 Tabagón–Goián (Concello de O Rosal)
The input text concerns a public works tender promoted by the Deputación de Pontevedra (Spain) for improving road safety on a provincial road in the municipalities of O Rosal and Tomiño.
It is drafted from the point of view of a Spanish contracting authority, applying Spanish public procurement law (Ley 9/2017 de Contratos del Sector Público) and referring to EU directives and standards (UNE-EN ISO 9001, ISO 14001).
The documents include the justificatory memorandum, the presidential resolution approving the tender, and the summary of the economic-administrative clauses and technical specifications published in the contracting profile.
As background, the contract is defined as an administrative works contract (“contrato de obras”) not subject to harmonised regulation (non SARA), with an open simplified procedure under article 159.1 LCSP.
The objective is to execute the approved project “Mellora da seguridade viaria na E.P. 3303 Tabagón-Goián mediante varandas e barreiras de seguridade.
The execution period is two months from the replanteo act, conditional on prior approval of the safety and health plan and the waste management plan.
Regarding what the bidder must submit and minimum qualification requirements, the procedure uses a single electronic envelope (“SOBRE ÚNICO”) containing administrative documentation and automatically quantifiable criteria.
As such, bidders must demonstrate general capacity to contract (capacity to act, not being prohibited from contracting, tax and social security compliance) and specific solvency.
Economic-financial solvency can be shown either by holding the appropriate works classification (Group G “viais e pistas”, Subgroup 5 “sinalización e balizamentos viais”, Category 1 up to 150.000 EUR) or, alternatively, by accrediting an annual turnover of at least 1.5 times the estimated value of the contract, i.e. 88.461,03 EUR.
Technical/professional solvency requires a list of works executed in the last five years with an accumulated amount in the year of greatest execution of at least 70% of the estimated value (41.281,81 EUR).
For newly created companies (less than five years old), solvency can be accredited by a declaration that they have the minimum personal and material means required.
Show all 30 statements
Additionally, bidders must submit a declaration committing at least the following staff as minimum means: one Contractor’s Delegate (min. 5 years’ experience on similar contracts), one Site Manager (civil engineer or equivalent, min. 3 years’ similar experience) and one General Foreman (min. 3 years’ similar experience).
Where applicable, commitments to apply systems equivalent to ISO 9001 and ISO 14001 are part of the offer (they are award criteria, not mandatory solvency certificates).
Concerning the scope of the contract (what, how much, where, when), the works consist of installing containment systems and protection elements (guardrails and safety barriers) to improve vehicle and pedestrian safety on the section of E.P. 3303 Tabagón–Goián between chainages PQ 1+200 and 1+620, i.e. 420 metres entirely within the Concello de O Rosal.
The CPV code is 45000000 (construction works).
The execution period is explicitly set at two months, without any possibility of extension, starting from the replanteo act once the safety and health plan and the waste plan are approved (as per clause 21 of the PCAP).
On award criteria and weighting, the contract is awarded on the basis of the best quality‑price ratio using only criteria evaluable by formula.
The criteria and maximum scores are: lowest price offered (price) – 75 points; increase of the percentage of quality control beyond the minimum required – 10 points (up to an additional 3% of the material execution budget); extension of the warranty period beyond the minimum – 10 points (up to a total of 36 months); commitment to apply a quality management system linked to the object of the contract (UNE‑EN ISO 9001 or equivalent) – 2.5 points; and commitment to apply an environmental management system linked to the object of the contract (UNE‑EN ISO 14001 or equivalent) – 2.5 points.
Thus, such as in bids where a contractor offers both maximum warranty extension and reinforced quality control plus certified ISO systems, they can obtain up to 25 points on qualitative improvements and 75 on price.
The documents justify the use of upper limits and the scoring formulas (based on comparison with the average bid reduction bm) as consistent with LCSP article 1 and doctrine of the Spanish Supreme Court (STS 205/2026), to avoid artificially excessive offers and ensure transparency and proportionality.
Regarding risks and special conditions, the documentation mentions standard contractual risks for works: responsibility for defects, technical verification and testing obligations, and the importance of adequate expertise due to road safety implications.
Subcontracting is explicitly permitted, but there are special execution conditions of social, environmental and innovation type under article 202 LCSP: such as obligations regarding inclusive language, ensuring payment to subcontractors, and applying the latest sectoral and territorial collective agreement for working conditions.
The guarantee period can be extended by the bidder as an improvement criterion; the basic mandatory guarantee and any penalties or performance bonds are likely detailed in the PCAP (CSV DIUZE98ZM1EWDFDY), although the exact amounts are not reproduced in the excerpt.
The tender is processed as ordinary (not urgent nor emergency).
The offer submission deadline is 20 natural days from the day following publication of the tender notice in the contracting profile, ending at 10:00 a.m. the next day.
There is no explicit mention of a compulsory site visit or of a separate question deadline; queries would normally follow LCSP rules and what is stated in the full PCAP.
The validity period of offers is not restated in the fragments but will be the LCSP default (usually 2 or 3 months) unless the PCAP sets a different period.
As to contradictions or corrections, the texts include a correction notice for the tender announcement: where the dates previously said “04/11/2026” they now say “10/11/2026”, and where they said “05/11/2026” they now say “12/11/2026”; an indicator with “Valor Desconocido” is eliminated.
Consequently, for interpreting deadlines and milestones, the corrected dates (10/11/2026 and 12/11/2026) in the latest announcement prevail over the original ones.
Only the contracting authority's tender documents are binding. As of: 20/10/2026
