Vergabeunterlagen Vermessungsleistungen Bushaltestellen Bernau bei Berlin (VOL/B, UVgO, BbgVergG)

The input text contains the national tender documents for surveying services related to bus stops in the city of Bernau bei Berlin, Germany.

It is based on German procurement law (UVgO), the General Terms and Conditions for the Execution of Services VOL/B (federal level), and the Brandenburg Procurement Act (BbgVergG), including its minimum wage provisions.

The perspective is that of a German contracting authority (Stadt Bernau bei Berlin, Land Brandenburg) inviting bids in an open procedure.

Such as described in the Bekanntmachung and the Aufgabenstellung, the scope of the contract is the provision of surveying services (“Vermessungsleistungen”) at specific bus stops (“An der Plantage”, “Hasenheide”, new stop L31 Ladeburger Chaussee/Sachtelebenstraße) in the city area of Bernau bei Berlin.

The work includes: complete digital survey of all visible above-ground objects and terrain forms, traffic facilities, vegetation, utilities and sufficient height points to derive a DGM, in the reference systems ETRS89/UTM and DHHN2016.

The deliverables are, such as stated, a 2D/3D situation and height plan in DWG/DXF with clear layer structure and a short technical report (fest points, methods, accuracies).

The contract period runs from 06.11.2026 to 31.12.2026, with data delivery (and thus performance end) by 31.12.2026 and invoicing by 15.01.2027; the contract is not divided into lots and the main place of performance is Bernau bei Berlin.

Regarding what the bidder must submit and minimum qualification, the documents specify, such as in the Bekanntmachung HVA L‑StB and the Aufforderungsschreiben, that offers are to be submitted electronically in text form via the Vergabemarktplatz Brandenburg by 04.11.2026, 11:00.

Required forms are in particular: the Angebotsschreiben (Formular 3.3), the Eigenerklärung Ausschlussgründe (Formular 4.1), and the “Vereinbarung zur Einhaltung der Mindestanforderungen nach dem Brandenburgischen Vergabegesetz” (Formular 5.3).

Where applicable, bidders must also submit: Erklärung Bietergemeinschaft (4.2) for joint tenders, Erklärung Unteraufträge/Eignungsleihe (4.3) and Verpflichtungserklärung anderer Unternehmen (4.4) if they use subcontractors or rely on third-party capacities, and optionally women-promotion declaration (4.5).

As minimum technical and professional capacity, at least one reference for comparable services from the last three financial years is required, including the contracting authority and telephone number.

Show all 32 statements

Economic/financial capacity and specific turnover or insurance proofs are explicitly marked as “entfällt” (not required); professional licence is covered via adherence to the BbgVergG and its form sheets.

The Eigenerklärung covers exclusion grounds (e.g. corruption, tax/social contribution breaches, labour law, Lieferkettensorgfaltspflichtengesetz) and must also be obtained from subcontractors before contract award.

Concerning award criteria and weighting, the Bekanntmachung states clearly that the award goes to the “wirtschaftlichstes Angebot” with the single award criterion “Niedrigster Preis”.

No qualitative subcriteria or weightings are foreseen; thus, as long as bidders meet the suitability (references, formal declarations, BbgVergG compliance) and submit complete, compliant documents, the lowest total price is decisive.

Nebenangebote (variants) are explicitly allowed; their admissibility is subject to the minimum requirements specified in the tender documents (though these specific minimum requirements are only generically referenced, not detailed in the extracted text).

Such as laid down in VOL/B and Formular 5.3, there are several risks and special conditions.

VOL/B governs, for example, execution duties (§ 4), obstruction and interruption (§ 5), quality control (§ 12), acceptance (§ 13), defect rights and limitation (§ 14), invoicing (§ 15) and payment (§ 17).

Contractual penalties (§ 11 VOL/B) are only effective if specifically agreed; limits are: max. 0.5 % per full week of delay on the value of the non-usable part of the performance and overall max. 8 %.

Separate from that, Formular 5.3 (BbgVergG) creates a substantial risk of contractual penalties: for each proven culpable underpayment of wages (relative to MiLoG/BbgVergG thresholds) or refusal to allow controls, a penalty of 1 % of the contract sum up to 25,000 EUR per case applies, capped in total at 5 % (max. 250,000 EUR); this also must be mirrored in subcontractor/agency contracts.

Formular 5.3 also grants the client a special termination right in case of breaches and allows reporting to a central exclusion list.

No security (guarantee) is required for this contract (“Sicherheitsleistungen: keine”), despite the general VOL/B rules (§ 18).

Subcontracting of essential parts of the service is only allowed with prior consent (§ 4 Abs. 4 VOL/B) and must be declared via 4.3.

The bid validity (“Bindefrist”) ends on 06.11.2026; questions can be submitted until 02.11.2026.

A mandatory site visit is not mentioned.

Termination and dispute resolution follow VOL/B § 8, § 9 and § 19, with exclusive jurisdiction at the seat of the authority’s legal representative if § 38 ZPO conditions are met.

With respect to contradictions or corrections, VOL/B § 1 Nr. 2 establishes a clear hierarchy in case of conflicting statements: (a) Leistungsbeschreibung, (b) Besondere Vertragsbedingungen, (c) Ergänzende Vertragsbedingungen, (d) Zusätzliche Vertragsbedingungen, (e) allgemeine Technische Vertragsbedingungen, (f) VOL/B.

In the present case, the specific Leistungsbeschreibung/ Aufgabenstellung (e.g. deadline 31.12.2026, data formats) prevails over general VOL/B clauses.

There is no explicit contradiction between the Bekanntmachung (“Leistungen sollen bis 31.12.2026 abgeschlossen werden”) and the Aufgabenstellung (data delivery by 31.12.2026); these statements are consistent.

Possible tension between VOL/B’s abstract rule on securities (§ 18) and the Bekanntmachung (“Sicherheitsleistungen: keine”) is resolved by the Bekanntmachung as the special rule: no security is owed.

Likewise, while VOL/B allows contractual penalties “wenn vereinbart”, Formular 5.3 concretely introduces wage-related penalties; as a specific contractual condition for this contract, it applies and complements VOL/B.
