Procurement documents University of Potsdam - Supply of a 3D printer (UVgO, State of Brandenburg)
The input text contains extracts from the procurement documents of the University of Potsdam (Germany, Land Brandenburg) for a supply contract ‘3D printers’ below the EU thresholds under the Sub-Threshold Procurement Regulation (UVgO).
These are standard forms of the State of Brandenburg (VHB-Bbg), application conditions (VOL 06), additional contractual conditions (VOL 08 – ZVB-Bbg) as well as information under public procurement law and data protection law in accordance with the GDPR and the Brandenburg Public Procurement Act.
All contents are formulated from the perspective of a German/Brandenburg contracting authority and subject the contract exclusively to German law.
With regard to the documents to be submitted and suitability requirements, the documents require in particular the offer letter (form 3.3), the price sheet/service description, the self-declaration of grounds for exclusion (form 4.1), the declaration on the applicant/tenderer community (4.2), the declaration of subcontracting/aptitude loan (4.3), the declaration of commitment from other companies (4.4) and the declaration according to the Women's Promotion Ordinance (4.5).
In addition, the contractual terms wage slip and price adjustment clause (5.2) and the agreement to comply with the minimum requirements under the Brandenburg Public Procurement Act (5.3) are part of the contract and must be accepted by the tenderer.
Formal minimum requirements for suitability are regulated by self-declarations (e.g. no grounds for exclusion under §§ 123, 124 GWB, taxes/social contributions, no insolvency proceedings, no grounds for blocking under AEntG, MiLoG, SchwarzArbG, LkSG).
If necessary, the client can request proof of professional registration and professional association.
A specific minimum turnover, reference number or sum insured is not defined in this text; These could be found in the Tender Specifications.
As regards the subject matter of the contract, the invitation to tender states that the University of Potsdam intends to procure the ‘supply/service of 3D printers’; the detailed technical specifications and quantities are set out in the price sheet/specifications, which are mentioned in the text only as an annex.
Unless stated otherwise in the tender specifications, the place of performance is the receiving department (University of Potsdam, registered office of the receiving agency, vacant place of use) in accordance with ZVB-Bbg.
The time structure is defined as follows: The closing date for requests for tenders is 29.10.2026, the closing date for the submission of tenders is 03.11.2026, 23:59 and the closing date for the submission of tenders is 30.11.2026.

Tenders must be submitted in German via the Vergabemarktplatz Brandenburg; a transmission by e-mail is expressly inadmissible, written offers are only admissible if this would be allowed and must then be submitted signed in the sealed envelope.
As regards the award criteria, the documents state that the contract will be awarded to the most economically advantageous tender, with a price weighting of 100%, as expressly stated.
Subsidiary tenders are not accepted and only one main tender must be submitted.
Lot splitting is not foreseen; the overall service must always be offered.
If the final price of the tender is exactly the same, the contracting authority will decide on the lot.
It also provides that discounts are to be counted only if the payment deadline is at least 14 calendar days; Payment terms of the contracting authority are based on the ZVB-Bbg (typically 14 days with discount or one month without deduction).
With regard to risks and special conditions, the documents shall specify in particular: Compliance with minimum fees under the Brandenburg Public Procurement Act or MiLoG/AEntG (Form 5.3, Form 5.2) including comprehensive control rights of the awarding authority (e.g. access to wage and salary documents, access rights to business premises, random checks); in the event of culpable infringements, contractual penalties of 1% of the order amount per case, a maximum of 5% or EUR 250,000, as well as order suspensions and termination rights are imminent.
The contractual conditions of the Land (ZVB-Bbg and VOL/B) provide, inter alia, for fixed prices, transfer of risk only upon acceptance by the receiving agency, binding execution deadlines, quality testing at the expense of the contractor and a right of withdrawal/termination in the event of certain breaches of duty (e.g. undue granting of an advantage).
As stated above, subcontractors may only be used with the consent of the contracting authority (except for insignificant partial services); Planned subcontracts must already be identified in the tender (Form 4.3) and additional declarations of commitment (4.4) must be attached in the case of a qualifying loan.
The period of validity of the tender expires on 30 November 2026, during which the tenderer is bound by its tender.
A mandatory site visit is not mentioned in the text; appropriate information is missing.
In terms of data protection law, Form 2.2 explains the processing of personal data, including queries in the competition register and in the blocking list of the State of Brandenburg.
With regard to possible contradictions or corrections, it is stressed on several occasions in the text that changes and additions to the procurement documents are inadmissible and that only the German contract versions are binding (any English versions are for understanding only).
The order of the contract elements is clearly defined by the ZVB-Bbg (first offer with specifications, if applicable contract document; then supplementary contract terms; then ZVB-Bbg; then VOL/B).
There are no obvious contradictions in content between forms; Statements on the tender form (electronically in text form via Vergabemarktplatz Brandenburg, no e-mail, signature only in the case of a written tender) are consistent between the invitation (3.1), the application conditions (VOL 06) and the individual forms (4.1-4.4, 5.3).
Only the contracting authority's tender documents are binding. As of: 27/10/2026
