Such as summarised in the “Verzeichnis im Vergabeverfahren vorzulegende Unterlagen” and the Aufforderung, bidders must submit with their offer: the Angebotsschreiben; the priced Leistungsverzeichnis; either the form “Preisermittlung bei Zuschlagskalkulation” or “Preisermittlung bei Kalkulation über die Endsumme”; the Angebot Lohngleitklausel (if they offer an Änderungssatz); the Erklärung zur Verwendung von Holzprodukten; the Vertragsformular(e) Instandhaltung; the Brandenburg minimum wage declarations Formular 5.3 (BbgVergG) and Formular 5.4 for Nachunternehmer; and, where applicable, the Verzeichnis der Nachunternehmerleistungen, the Erklärung Bieter-/Arbeitsgemeinschaft, and the Verzeichnis der Leistungen/Kapazitäten anderer Unternehmen. The offer must be in German, use the provided forms, be submitted electronically via the Vergabeplattform (or in a sealed envelope to the named Vergabestelle) by 09.11.2026, 08:00, and the bidder must be identifiable and sign where required.

Such as set out in the Eigenerklärung zur Eignung and the PQ rules in the Teilnahmebedingungen, minimum qualification requirements are: either a PQ-Nummer (Eintrag im Präqualifikationsverzeichnis) or, for non‑prequalified firms, the completed “Eigenerklärung zur Eignung” including turnover in the last three financial years for comparable works and a declaration of having executed comparable services in the last five calendar years. If the offer comes into the “engere Wahl”, the bidder must on request submit three detailed reference certificates, staff numbers over the last three years (broken down by wage groups and managerial staff), proof of business registration (Gewerbeanmeldung/Handelsregister/Handwerksrolle or IHK), tax and Sozialkasse clearance certificates, Freistellungsbescheinigung nach § 48b EStG, a Berufsgenossenschaft clearance certificate showing wage sums, and proof of Betriebshaftpflichtversicherung with coverage limits and responsible branch. In addition, Formblatt 4.1 EU “Eigenerklärung Ausschlussgründe” must be provided on demand, covering criminal, tax and labour law exclusion grounds under German and EU rules.

Such as described in the award section of the Aufforderung, the sole explicit Zuschlagskriterium is the price. The contracting authority determines a Wertungssumme from the recalculated Angebotssumme, taking into account unconditional discounts, the effect of any offered Lohngleitklausel and any Instandhaltungsangebote. There is a specific social bonus: if the bidder is a recognised Werkstatt für Behinderte, a 15 % bonus is applied to the Wertungssumme, and if such an offer is equally economical as another, the workshop’s offer receives the award. Technical and qualitative requirements are not part of the formal weighting but must be fully met; Nebenangebote are permitted under conditions and must be qualitatively and quantitatively gleichwertig and comply with all technical specifications.

Such as set out in the Besondere Vertragsbedingungen, Anlage Punkt 10 and the Brandenburg minimum wage forms, key risks and special conditions include: contractual penalties under § 11 VOB/B of 0.2 % of the net contract sum per working day of delay in start or completion (or applicable Einzelfristen), capped at 5 % of the net contract sum; strict minimum wage obligations of at least 13.00 € brutto/hour under the BbgVergG for all staff (including those abroad), with extensive rights of the contracting authority to inspect anonymised/pseudonymised payroll and bank transfer records and to conduct on-site interviews. Breaches of these labour obligations can lead to reporting to Zollbehörden, entry on a central Sperrliste for up to three years, contract termination, and additional contractual penalties of 1 % of the contract sum per verified case (max. 25,000 € per case, 5 % and 250,000 € overall). For Nachunternehmer and labour providers, the bidder must secure identical undertakings by them via Formular 5.4 and ensure that any subcontractor with an Auftragssperre is replaced promptly. There are also deductions for media consumption: 0.10 % of the final account for water, 0.25 % for electricity and 0.10 % for sanitary facilities. Weekly site meetings are mandatory; at least one competent representative must attend and German must always be spoken on site, with a German‑speaking contact present. Disputes go to the ordinary courts at the AG/LG competent for the Auftraggeber, and the warranty period for works is four years.

Such as derived from the Teilnahmebedingungen and technical preamble, subcontracting is allowed but controlled: intended Nachunternehmerleistungen must be listed with type and scope in the offer, and on request the concrete subcontractors must be named and show PQ or equivalent eligibility; further subcontractors can only be engaged if they sign matching minimum‑wage and control declarations. The bidder bears full responsibility for safety measures, site setup costs, daily removal of waste, protection of building components and fixtures, and must conduct a site visit (“Bauzustandsbesichtigung”) before bidding; claims arising from lack of knowledge of site conditions are excluded. Aside from the general instruction to report any “Unklarheiten” in writing to the Vergabestelle before submitting the offer, no explicit fixed question deadline is stated, so bidders must raise questions “unverzüglich” and within the offer period. The Bindefrist for offers runs until 06.12.2026. Regarding contradictions, the Besondere Vertragsbedingungen page 2 contains template text on securities (5 % performance, 3 % defects) but is overridden in this project by the concrete clauses immediately above stating that “Auf Sicherheit für die Vertragserfüllung wird verzichtet” and “Auf Sicherheit für die Mängelansprüche wird verzichtet”; these project‑specific waivers are the applicable conditions, while the standard percentages are part of the unedited form and do not apply here.
