Public tender for the district of Havelland: Supply of hardware (workstations and monitors) for the Cadastre and Survey Office
The text deals with a procurement procedure of the rural district of Havelland (Germany, Federal State of Brandenburg) for the supply of IT hardware (PC workstations and monitors) under German procurement and contract law (UVgO/VgV, GWB, BbgVergG, VOL/B, EVB-IT).
With regard to the content of the tender and the suitability requirements, the document ‘1.02 Compilation of documents to be submitted’ and the cover letter lay down, inter alia: The tender must be accompanied by the lot-specific price sheet (2.01), the offer letter (2.02), the agreement on compliance with the minimum requirements under the BbgVergG for the tenderer (FB‐3‐06), product data sheets per product offered, the self-declaration on §§ 44, 45 VgV (FB‐1‐01, with information on the company, register, IHK/HWK, business purpose, SME status, prequalification, business/professional liability insurance), the self-declaration on the absence of grounds for exclusion pursuant to §§ 123, 124 GWB (FB‐1‐02) and, if applicable, the joint bid declaration (FB‐3‐03), self-declaration of subcontractor services (FB‐3‐04) and self-declaration of suitability loan (FB‐3‐05).
Upon request, proof of register and insurance and, for subcontractors and suitability lenders, their self-declarations (FB‐4‐01, FB‐4‐02) as well as letters of commitment (FB‐4‐04, FB‐4‐05) and BbgVergG agreements (FB‐4‐06) must be submitted.
Specific minimum turnover or reference requirements are not defined separately in this section, but a business/professional liability insurance (existing or to be concluded) with certain coverage amounts as economic-financial suitability.
With regard to the scope of the contract, price sheets and EVB-IT sales contracts mention in particular: Lot 1 concerns 11 PC workstations including free-of-use delivery, Lot 2 monitors (e.g. 6 × 27", 8 × 34") including delivery; the detailed quantities per lot are specified in document 2.01 Price sheet_lot-specific.
The place of supply is the cadastral and surveying office of the district of Havelland in Nauen (Waldemardamm 3); Invoice address and e-invoice are mentioned separately.
The hardware shall be delivered by 11.12.2026 at the latest; in the tender letter, the tenderer must expressly confirm for each lot that he can guarantee this delivery date, failing which this is expressly stated as a ground for exclusion.
In addition to the purchase, the contracts provide for maintenance (possibly to be specified later) with a monthly lump sum; EVB-IT Kauf-AGB, EVB-IT Überlassung-AGB/ Instandhaltungs-AGB and subordinated VOL/B are applicable.
With regard to the award criteria and their weighting, the excerpt only states that ancillary offers are not admissible and that all required performance characteristics must be provided without additional costs, provided that no additional costs are indicated and explained in the price sheet.
The present section does not contain an explicit list of the evaluation criteria (e.g. price vs. quality with percentage weighting); however, it is clear that the total offer price per lot is to be mentioned in the offer letter and discount/discount can be indicated.
With regard to risks and special conditions, the documents lay down, inter alia: The tender is binding until the expiry of the period of validity on 25.11.2026, the contract will be awarded without separate signature of the contract by means of an award declaration.

Processing is carried out electronically via the Brandenburg public procurement marketplace, whereby text form or (advanced/qualified) signature are permitted.
Subcontracting is permitted in principle, but requires designation in FB‐3‐04 and subsequently the consent of the contracting authority; Subsequent subcontracting is only permitted with written consent. aptitude loan is possible, but requires an assumption of liability by the aptitude lending company and corresponding declarations of commitment; where economic capacity is used, it shall be liable with the tenderer for the performance of the contract.
BbgVergG imposes minimum wage requirements; in the case of culpable reductions in fees or violations of control obligations, contractual penalties of 1% of the order amount per case (max. 25,000 €), a total of maximum 5% (max. 250,000 €) and a right of termination of the client are agreed.
VOL/B and EVB-IT-AGB also contain provisions on contractual penalties for delays, securities (e.g. guarantees, blocked accounts), liability for defects, quality testing, acceptance, obstruction and disputes (jurisdiction of the client; obligation to continue in the case of special public interests).
On contradictions or corrections: The order of precedence of conflicting contractual elements is clarified in VOL/B § 1 paragraph 2 (priority service description, then special, supplementary, additional conditions, technical contractual conditions, last VOL/B).
As far as visible, there are no contradictions in terms of content in this section, but only different forms of presentation of the same specifications (e.g. the list of documents appears identical in the cover letter and in ‘1.02 Compilation of documents to be submitted’).
Only the contracting authority's tender documents are binding. As of: 27/10/2026
