Procédure de marché public pour la fourniture d’EPI aux centres de formation au Burundi
The input text concerns a Belgian public procurement procedure, managed by Enabel (Agence belge de coopération internationale), for the supply of personal protective equipment (EPI) to vocational training centres in Burundi.
It is written from the point of view of the Belgian contracting authority applying Belgian public procurement law (law of 17 June 2016, royal decrees of 18 April 2017 and 14 January 2013), but the execution of the contract and deliveries take place in Burundi (notably Bujumbura and various CEM/CFP sites).
The text specifies in detail what bidders must submit and which minimum qualification requirements apply.
Such as, bidders must use the provided forms: identification sheet, list of subcontractors, offer‑price form, and declaration on honour regarding exclusion grounds.
They must also submit at least two validated references for similar supply contracts over the last five years, including at least one general supply contract and one specifically for EPI, each of a minimum value of 120,000 EUR.
Furthermore, bidders must provide certificates of conformity for the EPI, including EU examination certificates for category 2 and 3 EPI, CE marking, and any quality‑control certificates issued by competent official bodies.
The scope of the contract is clearly defined.
Such as, it is a single, non‑lot supply contract for EPI for learners and trainers in Centres d’Enseignement des Métiers (CEM), Centres de Formation Professionnelle (CFP) and Unités d’Appui et de Production Pédagogique (UAPP) in Burundi, under CPV code 18143000‑3.
The contract covers all items listed in the offer‑price form; partial offers per item are not allowed.
The contractual duration is 120 calendar days from notification of award: 30 days for preparing and validating samples/BAT, and 90 days to produce and deliver the full order.
Deliveries must be made to the different CEM and CFP sites (details in the TDR), with a conformity verification session in Bujumbura before onward distribution.
Offers must be submitted in French, in euro, by 24 November 2026 at 10:00 (GMT+2), and remain valid for 90 days from that deadline.

The award criteria and weighting are simple and entirely price‑based.
Such as, the only award criterion is price with a weight of 100%, evaluated using the formula Pcot = 100% × (Pb/Pc), where Pb is the lowest bid price and Pc the price of the bid being scored.
The procedure is a negotiated procedure with prior publication: after formal and substantive regularity checks, the contracting authority may shortlist bidders based on the award criterion, conduct negotiations (without modifying minimum requirements or award criteria), and request BAFOs (Best and Final Offers).
After negotiations, BAFOs are evaluated again on price; the bidder with the highest final score and who passes exclusion and selection checks is awarded the contract.
The authority is not obliged to award and may restart the procedure.
The text also sets out risks and special conditions for bidders.
Such as, there is a mandatory 5% performance guarantee (cautionnement) on the total contract value (excluding VAT), which can be constituted with a bank or insurance guarantee, including via institutions based in the destination country, subject to Enabel’s approval.
Price revisions are generally not allowed, except for specific changes in taxation (impositions) meeting defined temporal and substantive conditions.
Penalties and measures are those of the “RGE”: delays may trigger fines; serious non‑performance can lead to measures d’office and replacement of the contractor, including via direct award to an existing subcontractor or to the second‑ranked bidder through an amendment.
The offer must detail any intended subcontracting; Enabel may, in case of contractor failure, conclude a “marché pour compte” with subcontractors or other bidders under well‑defined conditions.
There is a 6‑month warranty period for specified EPI items, strict delivery deadlines (120 days, deemed of rigour), exclusion grounds and conflict‑of‑interest rules (including “tourniquet” situations), and a fixed question deadline: written questions to the procurement expert up to the 10th day before the offer deadline; clarifications and corrections are published at the latest by the 7th day before that deadline.
No information session or site visit is foreseen.
Regarding contradictions or corrections within the documents, the input text clarifies which statements prevail.
Such as, the cahier spécial des charges is complemented by annexed Terms of Reference (TDR); where both speak about deadlines (120 days, split into 30 + 90) and delivery sites, they are consistent and mutually reinforcing.
In case of conflict between documents, the hierarchy is: the special specifications (CSC), its conditions particulières and annexes, the approved BAFO, and the award notification letter.
The contracting authority also stresses that any deviation or informal agreement not formally notified by Enabel is null and void, ensuring that the latest published and formally notified provisions govern the interpretation of the contract.
Only the contracting authority's tender documents are binding. As of: 31/10/2026
