Public audit contract for biodiversity-related services in Belgium

This input text concerns a Belgian public procurement procedure launched by the Belgian State (SPF Santé publique / FOD Volksgezondheid) for an audit-type services contract relating to biodiversity and the BeBiodiversity ecosystem.

It is drafted in parallel French and Dutch versions and refers throughout to Belgian law on public contracts, Belgian authorities and Belgian administrative procedures.

The point of view is that of the Belgian contracting authority, setting out the legal framework and practical requirements for economic operators wishing to submit a bid.

The documents explain in detail what bidders must submit and the minimum qualification requirements.

Such as: use of the official offer form (formulaire d’offre/offerteformulier), identification data of the bidder (BCE/KBO number for Belgian firms, legal form, etc.), and a globally priced offer in EUR.

For exclusion checks, bidders (and each member of a consortium and each third whose capacity is used) must provide evidence on fiscal and social debts, non‑bankruptcy status, and an extract from the criminal register (special Belgian model 596.1–32 or equivalent foreign document, less than six months old).

As further proof of compliance with social, labour and environmental law, the bidder must obtain an attestation from the Belgian administrative fines directorate showing no level 3 or 4 fines under the Social Penal Code, and sign/submit a specific environmental compliance declaration (annex).

For technical selection, minimum requirements include: a certified environmental management system (ISO/EMAS or similar) or, failing that, an internal environmental policy supported by evidence; plus references to services carried out in the last three years with specific minimum values and thematic relevance (at least three comparable studies/projects of ≥50,000 EUR incl. VAT for posts 1 and 3, and at least two comparable studies/projects of ≥30,000 EUR incl. VAT for post 2, with specified domains and clients).

These references must be listed with amounts, dates, duration, brief descriptions and client identities, backed by attestations or declarations.

When relying on the capacity of third parties, bidders must attach signed commitments from these entities and clearly indicate for which part of the contract their capacity is used.

The scope of the contract is defined as a services contract for audit and analytical work, CPV 79212000‑3 (audit services), covering three posts: (1) analysis/mapping of the landscape of business support in biodiversity in Belgium, (2) audit of the BeBiodiversity ecosystem and its associated tools (including BiodiversiTree), and (3) integrated analysis of the positioning and potential role of the Biodiversity service plus strategic recommendations.

Such as: the contract duration is 12 months from the date of conclusion, with no renewal, and services must always be completed within this timeframe (excluding the contractor’s annual closure days).

Show all 34 statements

The place of performance is primarily the contractor’s premises, except for at least two kickoff/closing/result-presentation meetings in the authority’s offices in Brussels (Avenue Galilée/Galileelaan 5/2).

Execution is monitored closely by a delegated official; anomalies must be notified by email and confirmed by registered or equivalent electronic post, and non‑conforming services must be redone.

Award criteria and weighting are clearly set out.

The contract is awarded to the economically most advantageous final offer (Best and Final Offer) based on two main criteria: price (50%) and quality of the offer (50%).

Such as: price scoring uses the standard proportional formula A = (Plowest / Poffer) × 50 on the total price including VAT; bidders must also provide a price breakdown per post.

The quality criterion is subdivided with detailed point scales and qualitative descriptors: methodological approach for post 1 (12 points), post 2 (10 points), and post 3 (12 points); planning per post and overall planning/faisability (8 points); and task distribution and work plan (8 points).

The methodological subcriteria assess clarity, relevance, robustness and added value of the proposed methods; planning subcriteria consider realism, coherence, milestones and dependencies; organisational subcriteria evaluate the clarity of roles, adequacy of profiles, appointment of a main contact person, and arrangements for coordination and quality control.

Regular offers are first checked for formal regularity; the authority can decide whether to negotiate.

If it does, negotiations are on initial and subsequent offers, but minimum requirements and award criteria are not negotiable.

A shortlist of up to three tenderers can be drawn up for negotiations; these tenderers may then submit a final offer.

Risks and special conditions are also addressed.

Such as: no variants or options are allowed; the contract is at global forfaitary price with no price revision clause (art. 38/7), meaning bidders must include all possible costs in their global price, excluding VAT.

No performance bond (cautionnement/borgtocht) is required.

The contract can be modified during execution through specific review clauses (art. 38 of the Belgian execution Royal Decree), covering: tax/heffings changes affecting the contract amount (art. 38/8); delays or damage due to acts/omissions by either party (art. 38/11); suspension ordered by the authority with potential compensation if strict conditions are met (art. 38/12); and unforeseeable circumstances disturbing the contractual balance in favour or to the detriment of the contractor (arts. 38/9 and 38/10).

Subcontracting is subject to prior authorisation by the authority, and bidders are asked to specify in their offer the share they intend to subcontract and the proposed subcontractors.

When capacity of third parties is used (e.g. for economic/financial strength or relevant professional experience), the authority may require joint and several liability for execution, and the contractor is obliged actually to use those entities in performance.

Advance payments are possible if the contractor is a SME (micro, small or medium) as defined by Belgian law and upon valid request; advances may be suspended or reclaimed in case of non‑compliance.

The tender must be submitted electronically via the Belgian e‑Procurement platform with a qualified electronic signature (QES) on the deposit report; email submission is explicitly forbidden, and scanned signatures are insufficient.

Regarding contradictions or corrections, the text clarifies that both the French “cahier spécial des charges” and the Dutch “bestek” are parallel versions for the same contract and that rectificative notices published in the Belgian “Bulletin des Adjudications” form an integral part of the tender documents.

Such as: where requirements appear in both language versions, they are consistent (e.g. 12‑month duration, 120‑day validity of offers, CPV code, exclusion and selection criteria, award criteria and their weighting).

There is an explicit statement that all documents and rectifications relating to the contract form part of the binding specification and must be taken into account by bidders.

No substantive contradictions are apparent within the provided excerpts; instead, the FR and NL texts mutually confirm each other on critical points like no price revision, no guarantee, absence of options/variants, selection thresholds for references, and evaluation methodology.

Tactics

When contracts were awarded in this country and sector, usually 5 or more bids came in. Many compete here — price and references decide. (Based on 2,001 completed awards — not a statement about this procedure.)

This procedure allows 24 days between publication and deadline — typical in this country is 34 (median of 3,233 procedures). Much tighter than usual: the first week counts.

The deadline falls on a Monday — your last full working day is the Friday before. Have evidence and guarantees together by Thursday.

Foreign bidders

In Belgium · Business services, 729 contracts went to foreign companies over the last 3 years (of 3,120 recorded awards) — mostly from France, Germany, Italy.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
