Procédure de marché public pour équipements neurophysiologiques au CHU de Liège
The input text concerns a Belgian public procurement procedure for medical equipment (EMG and evoked potentials machines) for the Centre Hospitalier Universitaire (CHU) de Liège.
It is drafted under Belgian law (loi du 17 juin 2016 sur les marchés publics, AR du 18 avril 2017, AR RGE du 14 janvier 2013) and refers to EU law on medical devices and data protection, but the point of view is clearly that of a Belgian contracting authority operating in Belgium.
The documents describe in detail what bidders must submit and the minimum qualification requirements.
Such as, the bidder must complete the official offer form (Annexe A), the inventory (Annexe B), the confidentiality charter (Annexe C), the data protection convention (Annexe D), the IT security annex (Annexe E), the turnover statement (Annexe F), certificates of good execution (Annexe G) and the site visit form (Annexe H).
The bidder implicitly declares not being in any exclusion situation and may later be asked to produce a recent criminal record extract and certificate of non‑bankruptcy.
They must also show evidence of mandatory insurances (accidents at work, civil liability) within thirty days of contract signature.
The scope of the contract is defined in terms of what is to be supplied, where and when, and for how long.
Such as, the supplies consist of three machines (one EMG machine and two machines for evoked potentials, in practice: one EMG at Sart Tilman and two evoked potentials machines, Sart Tilman and Esneux) plus all related hardware, software, installation, training, documentation, maintenance during warranty and optional services.
The machines must meet detailed technical specifications (e.g. ≥8 recording channels, sampling up to 10 kHz, specific safety features, dual stimulator, etc.).
Place of performance is the neurology services of CHU Sart Tilman (Liège) and CHU Ourthe‑Amblève (Esneux), with precise routes and delivery times (weekdays, specific hours).
The three machines must be delivered and installed simultaneously, within a maximum of 12 weeks from purchase order, and the contracting authority has 30 days for provisional acceptance after simultaneous installation.
Award criteria and weighting are clearly specified.

Such as, the economically most advantageous tender is chosen based on three criteria: (1) Price (50 points) calculated by a proportional formula comparing to the lowest bid, considering base offer and required options (excluding preventive maintenance); (2) Technical value (40 points), broken down into four sub‑criteria of 10 points each for EMG, visual/auditory evoked potentials, somatosensory evoked potentials, and motor evoked potentials, assessed from documentation and tests; and (3) After‑sales services (10 points), evaluated on the proposed support organization (location and number of technicians, competencies, response and intervention times, spare parts availability, remote control capabilities, etc.).
Only regular offers are evaluated; the contracting authority may conduct negotiations and request a Best and Final Offer (BAFO), but minimum requirements and award criteria are not negotiable.
The documents also set out numerous risks and special conditions for bidders and the future contractor.
Such as, the bidder is bound by its offer for 120 days (for initial, negotiated and BAFO offers).
Subcontracting is allowed only with prior approval, at one level only, with the contractor remaining fully responsible; cession of the contract is prohibited without written authorization.
Strict penalties apply: €100 per calendar day of delay in delivery, €100 per day for breach of agreed intervention times in case of breakdown, and specific penalties of 4% of the initial contract amount per breach of data‑processing instructions or data‑protection obligations by subcontractors, in addition to statutory delay fines (0.1% per day, max 7.5% of order value).
The contractor may not slow or suspend execution even in case of payment delays or disputes (derogation to AR RGE art. 70; exception non adimpleti contractus excluded).
The bidder must also promptly provide demonstration equipment for testing (within seven days of request) on the specified sites, free consumables, and possibly bear insurance for test equipment.
Regarding contradictions or corrections within the documents, the text itself sets a mechanism for resolving them.
Such as, bidders are explicitly required, under art. 81 AR 18 April 2017, to signal any discordances, errors, incoherences or contradictions in the tender documents no later than 10 calendar days before the offer deadline, via the designated public forum, and to suggest missing characteristics or functionalities.
The tender states that all notices and corrigenda published in the Belgian Bulletin des Adjudications and relating to this market form an integral part of the special specifications, and the bidder is deemed to have taken them into account.
Where the special specifications derogate from general regulations (e.g.
AR RGE art. 70, payment deadlines), the special specifications expressly prevail and specify the applicable rule.
Similarly, the contract documents state that by submitting an offer, the bidder accepts all clauses of the cahier spécial des charges and renounces its own general conditions even if annexed, clarifying that in case of any conflict between bidder documentation and the tender documents, the tender documents apply.
Only the contracting authority's tender documents are binding. As of: 26/10/2026
