Public contract for the supply of children’s car seats for Fedasil Charleroi (Belgium)
The input text concerns a Belgian public procurement procedure launched by Fedasil (the Federal Agency for the Reception of Asylum Seekers) for the supply of children’s car seats to the Fedasil centre in Charleroi (Jumet).
The documents are bilingual (Dutch “Offerteaanvraag LEVERINGEN – Zonder perceel” and French “Demande d’offre FOURNITURES – Sans lot”) and describe a “marché public de faible montant / overheidsopdracht van beperkte waarde” governed by Belgian public procurement law (law of 17 June 2016, royal decrees of 18 April 2017 and 14 January 2013).
The perspective is clearly that of Belgian contracting authorities and Belgian legislation, with references to Belgian VAT rules, BCE number, and Belgian payment regulations.
Such as in the introductory sections, the documents explain that the object of the contract is the supply (“levering/fourniture”) of children’s car seats (CPV 34370000-1).
The contract is not divided into lots (“Zonder perceel / Sans lot”).
The place of performance is Fedasil Charleroi, Zoning industriel, 2ème rue 24, 6040 Jumet, and the contract is a “one shot” order: delivery must take place within three weeks from receipt of the purchase order/bon de commande.
Thus, scope-wise: one global-price supply contract, fixed quantities as per the inventory in Annex B, one delivery location, and a short execution period.
Such as in the sections on submission and conformity of offers, bidders must introduce their offers electronically via the Belgian e-Tendering platform (https://www.publicprocurement.be / https://eten.publicprocurement.be); any offers submitted by email are null and void.
To be compliant, the offer must be signed by a person authorised to bind the economic operator and must contain all information requested in the tender documents (for example technical data sheets and, where applicable in other contracts, certificates of site visit, although in this case a site visit is explicitly “zonder voorwerp / sans objet”).
There is no mention of specific minimum qualification requirements such as minimum turnover, specific insurance levels, or mandatory references; therefore, apart from general legal eligibility under Belgian law, no additional quantitative selection thresholds appear.
Bidders may attach their own general terms and conditions, but only insofar as they complement – and do not contradict – Fedasil’s administrative and technical conditions; any contrary condition is deemed null.
Such as in the pricing and award criteria sections, the contract is a global-price market (“marché à prix global / opdracht met globale prijs”) with forfaitaire quantities.

The proposed price must include all administrative costs (especially invoicing) and delivery costs.
Prices are fixed for the entire duration of the contract and no price revision is permitted.
The only award criterion is price: the lowest total price based on the overall inventory/offer will be selected (“uniquement le prix (le prix le plus bas) / alleen de prijs (de laagste prijs)”).
There is no weighting for quality, technical merit, or environmental aspects, so economic operators must focus on offering compliant products at the lowest possible price while respecting the technical specifications.
Such as in the parts describing risks and special conditions, the documents specify several important contractual and procedural conditions.
Offers must be valid for 90 calendar days from the deadline for receipt of offers; if negotiations are opened, the commitment period is automatically extended to 90 days from the BAFO (Best and Final Offer) deadline, even for bidders who do not submit a BAFO.
Fedasil reserves the right to negotiate (for clarification, missing documents, or improving conditions such as price) and will close negotiations by inviting BAFOs; BAFOs cannot be modified afterwards.
Payment is made by electronic invoice via the Mercurius platform (PEPPOL-compliant) within 30 calendar days of receipt of the deliveries or completion of services, provided Fedasil has the correctly established invoice and any required supporting documents (delivery notes, PV of receipt, etc.).
The contractor must ensure that electronic documents are virus-free; infected documents can be deemed not received.
The general execution rules of the royal decree of 14 January 2013 apply, including payment modalities, penalties for delay, recording of execution defects and “mesures d’office / ambtshalve maatregelen”; for the last two, the usual formalism is relaxed and notices may be sent by email instead of registered mail.
No specific guarantees, performance bonds or rules on subcontracting are detailed.
Additionally, there is a confidentiality clause requiring strict compliance with GDPR and Belgian data protection law, and a “dimension de genre / genderdimensie” clause: the contractor must analyse whether differences exist between women and men in the domain covered by the contract and take into account any such differences in execution.
Such as in the bilingual repetitions, there are no substantive contradictions between the French and Dutch versions: both describe the same scope, procedure type, place of performance, one-shot delivery within three weeks, electronic submission only, fixed prices without revision, sole award criterion of lowest price, 90-day validity and BAFO-extension rules, applicability of the same legal framework, electronic invoicing via Mercurius, GDPR confidentiality obligations, and gender mainstreaming requirements.
Where statements appear twice, they are parallel language versions rather than conflicting rules.
In case of doubt, Belgian practice would typically treat both language versions as authentic; however, the content shown is consistent, so there is no indication that one version should prevail over the other for interpretation.

Tactique
