Operatorul economic va completa respectivul punct din partea IV cu DA sau NU fara sa trebuiasca sa completeze nicio alta sectiune din partea IV, sectiunile A, B, C sau D, utilizand indicatia globala. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Cerinta se aplica inclusiv pentru subcontractanti care completeaza informatiile aferente situatiei lor la nivelul unui DUAE distinct. Persoanele juridice straine pot prezenta documente echivalente, emise în conformitate cu legislatia aplicabila în tara de rezidenta (acolo unde este aplicabil). Documentele se vor prezenta însotite de traducerea autorizata a acestora in limba romana. Se va completa DUAE în conformitate cu art.193 alin.(1) din Legea nr.98/2016. Documentele justificative care probează îndeplinirea celor asumate prin completarea DUAE (conform prevederilor art. 12 alin 6 din Instructiunea ANAP nr. 2/2017) urmează a fi prezentate la solicitarea autorității contractante, doar de către ofertantul clasat pe primul loc după aplicarea criteriului de atribuire. Ofertantul trebuie sa faca dovada ca a realizat in ultimii 3 ani in cadrul unuia sau a mai multor contracte, furnizare de produse similare in valoare CUMULATA de minim 15.000.000,00 lei fara TVA . In cazul decalării termenului limită de depunere a ofertelor, perioada de 3 ani calculată inițial se extinde cu perioada de timp aferentă decalării. Prin produse similare se intelege : Furnizare de carburanti.
