Purchase of electricity for PWiK Sp. z o.o. facilities for the period from 01.01.2027 to 31.12.2027

… local Distribution System Operator (DSO). The Contracting Authority requires that the Contractor performing the order at the latest on the date of conclusion of the sales contract has concluded a binding contract with the DSO, on the basis of which it is possible to sell electricity via the distribution network of that DSO to all the facilities of the Contracting Authority indicated in Annex 4 to the ToR. 4) Settlements for supplied electricity will take place on the basis of indications of metering and billing systems at unit prices for a given consumption point on the basis of actual energy consumption and will be increased by the value of the fixed component payable monthly, specified in the Contractor's price offer (commercial fee). 5) The Ordering Party has the legal title to dispose of the facilities described in Annex 4 to the ToR. 6) The Ordering Party requires that the settlement period is consistent with the settlement period of the DSO. 7) The Ordering Party shall conclude one sales contract covering all collection points of the Ordering Party. 8) The Ordering Party allows the conclusion of a comprehensive agreement for sale and distribution. 9) The Ordering Party allows the possibility of signing the contract by correspondence or in electronic form (using an electronic signature). 10) The Contractor shall conclude on behalf of the Ordering Party a contract for the provision of distribution services in the case of collection points for which comprehensive contracts have been in force so far and in the case of collection points for which a distribution contract has been concluded for a definite period of time. The contracting authority provided for the time necessary to conclude a distribution agreement for energy consumption points for which the distribution agreement is not concluded for an indefinite period. 11) The Ordering Party did not conclude any agreements or promotional annexes. 12) The purchased energy will be used exclusively for own needs. The Ordering Party declares that it is the final consignee within the meaning of the Excise Duty Act of 6 December 2008 (Journal of Laws No. of Laws 2026, item 412 as amended). 13) The Ordering Party has the status of a manufacturer referred to in Art. 39 of the Act of 20 February 2015 on renewable energy sources (Dz. of Laws 2026, item 68 as amended). 14) The rules for the repurchase of surplus electricity are set out in Annex 2b – Offer form – repurchase and Annex 3 – Model contract. 15) The contracting authority provides for the possibility of reducing the number of electricity consumption points referred to in Annex 4 to the ToR with a 30-day notice period. 16) The Contractor is obliged to perform the order on the terms and conditions described in the model contract constituting Annex 3 to the ToR.
