The contracting authority does not reserve the right to apply for the award of the contract only by the contractors referred to in Article 94 of the Act. 6. The contracting authority requires that, in accordance with Article 95 of the Act, activities relating to the direct protection of persons and property, with the exception of the operation of an intervention group and remote monitoring services, be carried out by employees of the Contractor or a subcontractor employed by the Contractor or a subcontractor under an employment contract within the meaning of the Labour Code of 26 June 1974 (i.e. Journal of Laws 2025, item 277 as amended). 7. In the case of subcontracting the operation of an intervention group or the implementation of remote monitoring services in individual stations or facilities, in accordance with the provisions of § 14 section 1 of the Draft Agreement, the Ordering Party requires a current concession for conducting business activity also by the Subcontractor, to the extent to which it will perform the contract. 8. Prior to the conclusion of the contract, the Ordering Party shall submit: 1) List of security guards holding a current occupational physician's certificate allowing them to work as a security guard and training in the provision of first aid BLS/AED, confirmed by a certificate (applies to one security guard of the Sports and Rehabilitation Centre on each change), in accordance with § 5 sec. 1 point 2 of the draft contract and with the model contained in Annex 5 to the contract, which must be provided before the date of conclusion of the contract; 2) A document confirming the provision of a performance guarantee – under the conditions set out in Chapter XXIII SWZ in accordance with § 11 of the draft contract, which must be delivered before the date of conclusion of the contract; 3) A copy of the current civil liability policy covering civil (contractual) and tort liability for conducting business activity in the field of protection of persons and property. The amount of third party liability insurance may not be lower than PLN 10,000,000.00 (in words: ten million zlotys) for one and all events covered by the civil liability agreement and proof of payment of the premium - in accordance with § 12 of the Draft Agreement, which must be delivered no later than on the date of conclusion of the agreement.
