Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului ce urmeaza a fi atribuit. Modalitate de indeplinire: - completare DUAE, urmand ca documentul justificativ, respectiv certificatul constatator emis de ONRC sau, pentru ofertantii straini, document echivalent emis in tara de rezidenta, sa fie prezentat doar la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor numai de catre operatorul economic clasat pe primul loc in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor. Din certificatul constatator emis de ONRC, se verifica si codul CAEN. Alte documente justificative care probeaza indeplinirea celor asumate prin completare DUAE: Daca un grup de operatori economici depune oferta comuna, aceasta cerinta trebuie indeplinita de fiecare membru al grupului, pentru partea de contract pe care o realizeaza. Se va completa DUAE de către operatorii economici participanți la procedura de atribuire a contractului de achiziție publică/sectorială cu informațiile solicitate de către autoritatea/entitatea contractantă – informații referitoare la îndeplinirea cerințelor privind capacitatea de exercitare a activității profesionale. Nedepunerea DUAE odata cu oferta atrage respingerea acesteia ca inacceptabila conform art. 215 alin. 4) din Legea nr. 98/2016 cu modificarile si completarile ulterioare si art. 137 din HG nr. 395/2016. 1. Ofertantii trebuie sa demonstreze ca in ultimii 3 ani (2023, 2024 si 2025) au furnizat produse similare (furnizare de gaze naturale) in valoare cumulata de cel putin 17.000.000 lei fara TVA la nivelul unuia sau mai multor contracte. Operatorul economic face dovada indeplinirii cerintelor privind capacitatea tehnica si profesionala declarate in DUAE prin prezentarea unei liste a principalelor livrari de produse efectuate in cursul unei perioade care acopera ultimii 3 ani calculati retroactiv (2023, 2024 si 2025) fata de termenul limita de prezentare a ofertelor. Se va preciza numarul si data contractului invocat drept experienta similara, valoarea si obiectul contractului, beneficiarul, ponderea si/sau activitatile pentru care a fost responsabil. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intocmit dupa aplicarea criteriului de atribuire. In cazul decalarii termenului de depunere a ofertei perioada se va calcula prin raportare la noul termen pentru depunerea a ofertei. 2. Se va prezenta Licenta de furnizare a gazelor naturale in conformitate cu Art 179 lit g din Legea 98/2016. Persoanele juridice straine vor prezenta documente echivalente licentei de furnizare emise in conformitate cu legislatia aplicabila in tara de rezidenta. Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire a acordului cadru cu informatiile solicitate de catre autoritatea contractanta. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I in clasamentul intermediar intocmit dupa aplicarea criteriului de atribuire.Documentele sunt necesare pentru a asigura achizitorul ca ofertantul este eligibil si capabil sa respecte cerintele tehnice in vederea asigurarii calitatii. Conform art. 29, alin. 1 din HG 395/2016 cu modificarile si completarile ulterioare documentele care urmeaza sa fie prezentate de ofertanti trebuie sa dovedeasca indeplinirea criteriilor de calificare si selectie. Conform art. 163 si 172 din Legea 98/2016 cu modificarile si completarile ulterioare, criteriile de calificare si selectie aplicate se refera la: a) motive de excludere a candidatului/ofertantului; b) capacitatea candidatului/ofertantului (capacitatea de exercitare a activitatii profesionale). Utilizarea mijloacelor electronice de comunicare este obligatorie, cu anumite exceptii specificate in art. 52 din HG 395/2016.
