What the buyer is looking for

1. The subject-matter of the present proceedings is the maintenance and repair of military equipment (ASD) of anti-aircraft missile systems (AAS): NEWĄ S.C. and components and parts thereof in 2026 - 2030. 2. The subject of the maintenance and repair service is the performance of operation support, hereinafter referred to as the support of the following SpW of all types and varieties such as: rocket guidance stations; b) rocket launchers; c) equipment for the transport and loading of rockets. 3. Support for the operation referred to in paragraph 2 is complementary to the potential of the User and military maintenance and repair bodies (WT) and will consist in removing malfunctions and maintenance of Military Equipment (SpW) and components included in their completion, created during their operation and impossible to remove by regular service equipment and military maintenance and repair…

… bodies due to the lack of technical, organizational or specialized equipment. 4. The service provided by the Contractor should include organizational and technical projects, the implementation of which is to ensure the reconstruction and maintenance of technical efficiency of subassemblies, assemblies, elements and packages in the scope of: emergency repairs and maintenance; modification of equipment; c) support the operation by electronic means; d) training. Due to the urgent need to award the contract, the Contracting Authority will apply shortened deadlines for submitting applications and submitting tenders (Art. 4 and paragraph. 7 in conjunction with Article 411, para. 16): Factual justification: The urgent need to award a contract refers to the actual needs related to the duration of the procedure and the performance of the contract. With regard to the procedures in question, the urgent need to award the contract is dictated by the need to ensure the security of the state and its residents, to ensure the inviolability of the country’s borders, to ensure the territorial integrity and independence of Poland and to carry out the constitutional and statutory tasks of the Polish Armed Forces. It is also worth recalling the fact that it is necessary to maintain the efficiency of radar stations, as they perform round-the-clock combat duty in the NATO Integrated Air and Missile Defense System (NATINAMDS) and the National Air Defense System of the Republic of Poland. It should be emphasised that, in accordance with the judgment of the National Board of Appeal of 14 July 2023, ref. KIO 1844/23, and the still-current resolution of the National Board of Appeal of 14 May 2019, ref. KIO/KD 40/19: • the intention of the legislator when introducing the provision of Art. 2(2) (by analogy with Article 412(2) CTMR) 4 of the Public Procurement Act) was to include a wide range of cases in which it would be possible to shorten the deadline for submitting tenders, • the acceleration of the procedure may occur due to previous human errors, and such errors did not even occur at the Contracting Authority. The urgent need to award the contract is met in the situation of needs, inter alia, affecting the defence of the country, when the need to take action was not caused by the negligent conduct of the contracting authority, prevents damage. This catalogue is not only a doctrinal argument, but also meets in the implemented law of other EU and NATO member states, e.g. where it has been established that urgency justifying the accelerated procedure can be used in the event of an unforeseen equipment failure, and broken equipment is necessary for the activities of the contracting entity. Bearing in mind, first of all, the ongoing armed conflict in Ukraine (threatening a possible spread to neighbouring countries, including the Polish State), as well as the constant migratory pressure from the territory of Belarus at the border of the Polish State, it is necessary to make orders that will enable counteracting the current threats, as well as prepare the Polish State for possible threats in the future. · 1. The subject-matter of the present proceedings is enforcement
