… addition, as part of the service provided, the contractor is obliged to collect and manage municipal waste from real estate remaining on the management board of the Kotuń Commune. The Ordering Party reserves the right to exercise the option specified in Art. 1 of the Public Procurement Act. The exercise of the right of option will consist in increasing to 25% the amount of municipal waste to be collected and managed, also in the event of exhaustion of the maximum amount of the contract intended for the implementation of the basic contract. The right of option referred to in paragraph 1 will be implemented on the following principles: 1) will be carried out under the same conditions as the basic contract, 2) the unit price of municipal waste collection and management under the option right will be identical to the basic contract, 3) about the intention to exercise the option right, the Ordering Party will inform the contractor in a separate letter / statement, 4) the Ordering Party will be able to exercise the option right if the maximum amount of the contract allocated for the implementation of the basic contract is used. U. z 2021 r. poz. 888), b) posiadania aktualnego zezwolenia na prowadzenie działalności w zakresie zbierania odpadów wydane przez właściwy organ zgodnie z ustawą o odpadach, w zakresie objętym przedmiotem zamówienia lub odpowiedni wpis do rejestru – zgodnie z art. 41 ustawy z dnia 14 grudnia 2012 r. o odpadach; c) posiadania uprawnienia do transportu odpadów wydanego przez odpowiedni organ zgodnie z obowiązującymi przepisami, w zakresie objętym przedmiotem zamówienia; W przypadku składania oferty przez Wykonawców występujących wspólnie wyżej wymieniony warunek musi spełniać co najmniej jeden z Wykonawców.

Equipment, plant and technical facilities

a) wymagane jest wykazanie wykonanych lub wykonywanych w okresie ostatnich trzech lat przed upływem terminu składania ofert, usług odbierania odpadów komunalnych, w tym, co najmniej jednej usługi wykonanej lub wykonywanej w sposób ciągły przez okres minimum 12 miesięcy, w wyniku, której Wykonawca odebrał odpady o łącznej masie minimum 1500,000 Mg. b) wymagane jest dysponowanie specjalistycznym sprzętem, w tym co najmniej: 2 samochodami przystosowanymi do odbierania zmieszanych odpadów komunalnych; 2 samochodami przystosowanymi do odbierania selektywnie zebranych odpadów komunalnych; 1 samochodem do odbierania odpadów bez funkcji kompaktującej - zgodnie z Rozporządzeniem Ministra Środowiska z dnia 11 stycznia 2013 r w sprawie szczegółowych wymagań w zakresie odbierania odpadów komunalnych od właścicieli nieruchomości. W w/w flocie pojazdów przeznaczonych do realizacji usługi musi znajdować się przynajmniej 1 pojazd kategorii N2 lub N3 rozumiany jako: • N2 to pojazdy/pojazd silnikowy o masie maksymalnej przekraczającej 3,5 tony, ale nieprzekraczającej 12 ton, • N3 to pojazdy/pojazd silnikowy o masie maksymalnej przekraczającej 12 ton co wynika z art. 4 ust. 1 lit. b Rozporządzenia Parlamentu Europejskiego i Rady Europy (UE) 2018/858 z dnia 30 maja 2018 r. w sprawie homologacji i nadzoru rynku pojazdów silnikowych i ich przyczep oraz układów, komponentów i oddzielnych zespołów technicznych przeznaczonych do tych pojazdów, zmieniające rozporządzenie (WE) nr 715/2007 i (WE) nr 595/2009 oraz uchylające dyrektywę 2007/46/WE). W/w pojazdy/pojazd napędzany musi być paliwami alternatywnymi t.j. energią elektryczną lub paliwami wykorzystywanymi do napędu stanowiącymi substytut dla paliw pochodzących z ropy naftowej lub otrzymywanych w procesach jej przetwórstwa, w szczególności wodorem, biopaliwami ciekłymi, paliwami syntetycznymi i parafinowymi, sprężonym gazem ziemnym (CNG), w tym pochodzącym z biometanu, skroplonym gazem ziemnym (LNG), w tym pochodzącym z biometanu, lub gazem płynnym (LPG) co wynika z art. 2 pkt. 11 ustawy z dnia 11 stycznia 2018 roku o elektromobilności i paliwach alternatywnych (tekst. jedn. – Dz. U z 2023 roku, poz. 875).
