What the buyer is looking for

The subject of the contract is the maintenance of cranes along with the removal of breakdowns and repairs in the following three buildings in Warsaw: 1) Center of New Technologies, ul. Banacha 2C – 6 devices, 2) Faculty of Physics, ul. Pasteura 5 – 7 devices, 3) Biological and Chemical Science Centre, ul. Gravels and Vighurs 101 – 7 devices. A detailed description of the subject-matter of the contract is set out in Annex 2 to the ToR and model contracts - draft provisions of contracts constituting Annex 4-4b to the ToR. 3. The contracting authority does not divide the contract into lots and thus does not allow the submission of partial tenders. The division of the contract into lots is a right of the Ordering Party, not its obligation. As is apparent from the wording of Article 91(1)(b) EUTMR, 1 PPL: ‘The contracting authority may award a contract in lots, each of which is the subject of…

… a separate procurement procedure, or allow partial tenders to be submitted in a single procurement procedure, specifying the scope and subject matter of the lots and indicating whether a tender may be submitted for one, several or all of the lots.’ As a result of the analysis carried out, the Contracting Authority considered that the division of the contract into lots was not justified due to the nature and scope of the subject matter of the contract. The performance of the contract by a single Contractor shall ensure consistency, proper coordination and responsibility for all the work carried out. The division of the contract into lots could lead to organisational and technical difficulties in coordinating the activities of several economic operators. In addition, the performance of the contract within one procedure may contribute to a more efficient performance of the subject matter of the contract and the contracting authority's performance of public expenditure in an effective manner. Therefore, the failure to divide the contract into lots is justified on organisational and economic grounds. The division of the contract in the procedure in question does not confer any advantage on the contracting authority. For these reasons, it is objectively justified and necessary to award the contract to a single contractor (or contractors jointly applying for the contract and jointly and severally liable for its performance). Pursuant to Article 257 of the Public Procurement Act, the contracting authority may cancel the procurement procedure if the public funds which the contracting authority intended to use to finance all or part of the contract have not been awarded to it. The Contracting Authority recommends that the Contractor carry out an on-site visit before preparing the tender. The Contractor shall bear full responsibility for the consequences of failure to properly consider the terms of performance of the contract. The date of the on-site visit should be agreed with Mr Arkadiusz KNYCHAŁA tel. 668 037 536 hours 09:00 – 14:00. The contracting authority shall not provide for the award of the contracts referred to in Article 214(1)(b) CTMR. 1 point 7 of the Public Procurement Act The requirements related to the performance of the contract in terms of employment by the contractor or subcontractor on the basis of the employment relationship of persons performing the contract performance activities indicated by the contracting authority (Article 95 of the Public Procurement Act) are set out in the draft provisions of the contracts constituting Annexes 4-4b to the ToR. The Contracting Authority will apply the procedure referred to in Art. 1 of the Public Procurement Act (i.e. the so-called reverse procedure). In the first place, the Contracting Authority will examine and evaluate the tenders and then make a qualitative selection of the Contractor whose tender was the highest rated as regards the absence of grounds for exclusion. REQUIREMENTS FOR WADIUM 1. The offer must be secured by a security for the entire period of binding the offer, in the amount of PLN 15,000.00. 2. The Ordering Party does not provide for the payment of a deposit in a currency other than PLN. 3. The security may be lodged in the following forms: (1) money; 2) bank guarantees; (3) insurance guarantees; 4) guarantees provided by the entities referred to in Article 6b para. 5 point 2 of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws No. Journal of Laws 2020, item 299
