… to the specification - ‘Price form’ - with the RIGHT OF OPTION being applied in view of the fact that it is not possible to determine the target number of users at the initiation of the procedure. The decision to execute or resign from an optional order (option) is the exclusive right of the Ordering Party. An optional order does not constitute an obligation of the Ordering Party to award it, nor does it constitute a basis for the Contractor to claim compensation for failure to perform this optional order. The right of option in question may be exercised by the Contracting Authority in stages/partly/fragmented/sequentially, but may be exercised no later than during the term of the contract in the present proceedings.
