2. The subject of the contract is the provision of comprehensive sales and distribution / transmission of gaseous fuel to the premises of Zespół Żłobków m.st. Warszawa. The list of establishments and the data on establishments are attached as Annex 3.2 to the ToR. The price calculation is attached as Annex 3.1 to the ToR. 3. The Contractor undertakes to supply Group E gaseous fuel at a pressure of not less than 1.6 kPa to installations located in the above-mentioned facilities and to transfer ownership of the gaseous fuel supplied to the Ordering Party. 4. … of Laws No. of Laws 2026, item 43), while the terms of performance of the contract result from the procurement documents 5. The forecasted demand for natural gas of the individual units covered by the contract is indicated in Annexes 3.1 (Price calculation) and 3.2 (PG data) to the tender specifications. The forecast demand for natural gas specified by the Contracting Authority in Annexes 3.1 and 3.2 to the ToR is estimated and does not constitute an obligation on the part of the Contracting Authority to purchase natural gas in the quantity specified. In the event of a difference between planned and actual consumption, the Contractor will not pursue any financial claims other than those resulting from the amount of gas consumed. The expected consumption of gaseous fuel is used only for the comparison of tenders in the tender evaluation criterion: price. 6. The Ordering Party declares that it is NOT an intermediary gas entity (within the meaning of the Excise Duty Act). 7. The Contracting Authority declares that the gaseous fuel collected on the basis of this contract is used for heating purposes for the purposes of crèches referred to in the Act of 4 February 2011 on the care of children up to the age of 3 (declaration for the purpose of charging excise duty). 8. The Contracting Authority informs that all the Contracting Authority’s outlets are covered by a comprehensive contract for the sale and distribution of natural gas concluded with myOrlen Sp. z o.o. – the contract is valid until 31 December 2026. 9. The Contractor will be obliged to perform the subject of the contract in accordance with the draft provisions of the contract, constituting Annex 9 to the ToR.
