… following statements or documents valid as of the date of submission, confirming, respectively, that the Contractor is not subject to exclusion from the procedure and meets the conditions for participation in the procedure, i.e.: a) up-to-date information from the National Criminal Register to the extent specified in Art. 1 points 1, 2 and 4 of the Public Procurement Act issued not earlier than 6 months before its submission - the Contractor who invokes the resources of other entities to demonstrate the absence of grounds for exclusion against them shall also submit the above-mentioned information from the National Criminal Register regarding these entities; a statement by the Contractor that the information contained in the declaration referred to in Article 125(2) is up-to-date; 1/125 sec. 5 of the Act, as regards the grounds for exclusion from the procedure indicated by the contracting authority:- Art. 1 point 3 of the Public Procurement Act: -Article 108(1) 1 point 4 of the Public Procurement Act with regard to the imposition of a prohibition on bidding for a public contract as a preventive measure, - Article 108 para. 1 point 5 of the PPL with regard to the conclusion of an agreement with other economic operators aimed at distorting competition, - Article 108 para. 1 point 6 of the Public Procurement Act, and - Article 7 sec. 1 of the Act of 13 April 2022 on special solutions to counteract support for the aggression against Ukraine and to protect national security (Journal of Laws 2022, item 835) – Article 5k of Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (‘the Regulation’), in accordance with Annex 9 to the ToR; c) the Contractor's statement within the scope of Article 108 par. 1 point 5 of the Act on non-membership of the same capital group within the meaning of the Competition and Consumer Protection Act of 16 February 2007 (Journal of Laws of 2020, item 1076 and 1086), with another economic operator who has submitted a separate tender, partial tender or request to participate in the procedure, or a declaration of belonging to the same capital group together with documents or information confirming the preparation of the tender, partial tender or request to participate in the procedure independently of another economic operator belonging to the same capital group, in accordance with Annex 8 to the tender specifications; d) current certificate or confirmation of entry in the register of entities performing medical activity in accordance with Article 100 of the Act of 15 April 2011 on medical activity. In the case of a Contractor established outside the territory of the Republic of Poland, admission to medical activities by an appropriate, authorized body from the country of the Contractor; the current powers of the basic occupational health unit referred to in Article 2(1)(b) CTMR; 2 of the Act of 27 June 1997 on the Occupational Medicine Service. 2.
