… Capacity Pack 50TB software licenses held by the Ordering Party. The subject of the contract is not a product or service intended for direct use by natural persons, including employees of the Ordering Party, but it concerns the maintenance of IT infrastructure for making backup copies and restoring data. Due to the nature of the contract, accessibility requirements for persons with disabilities and design for all users referred to in Art. Paragraphs 1 and 2 of the Public Procurement Act do not apply. The performance of the contract shall not entail the supply or creation of a product, service or solution intended for general use by end-users for which specific accessibility requirements could be identified. In view of the above, the Contracting Authority refrains from defining accessibility requirements, as in its opinion the nature of the contract does not justify their introduction, they are not related to the subject matter of the contract and would not affect the manner of its implementation. 5.
