M1. Alkalmatlan az ajánlattevő, ha nem rendelkezik az eljárást megindító felhívás feladásától visszafelé számított három évben (36 hónapban) befejezett, de legfeljebb hat éven (72 hónapon) belül megkezdett, az előírásoknak megfelelően teljesített, min. 6 db MSAN eszköz (vagy azzal egyenértékű eszköz) szállítására vonatkozó referenciával. MSAN eszköz definíció: IP (internet protocol) és TDM (time division multiplexing) alapon szolgáltatott adatátviteli hangkommunikációs és IP szolgáltatásokat biztosító hálózati eszköz. Az alkalmassági követelményben elvárt mennyiség több referenciával is igazolható. A 321/2015. (X.30.) Korm. rendelet 21/A. § alapján a Korm. rendelet 21. § (1) bekezdés a) pontja alkalmazásában az ajánlatkérő a teljesítés igazolásaként köteles elfogadni annak igazolását is, ha a referencia követelményben foglalt eredmény vagy tevékenység a szerződés részteljesítéseként valósult meg. Ajánlatkérő köteles elfogadni azon megvalósult teljesítések igazolását is, amelyek esetén bár szerződésszegés történt, de a gazdasági szereplő szerződésszegésért való felelőssége – a szerződést kötő másik fél által nem vitatottan – nem áll fenn. Igazolási mód: A Kbt. 67. § (1)-(3) bekezdése szerint az ajánlattevő ajánlatában köteles az alkalmassági követelményeknek való megfelelés tekintetében az egységes európai közbeszerzési dokumentumba (EEKD) foglalt nyilatkozatát benyújtani. Ajánlatkérő az EEKD IV. részében szereplő részletes információk megadását nem kéri, elegendő a IV. rész „alfa” szakasz kitöltése. A Kbt. 69. § (4) bekezdése, illetőleg (6) bekezdése szerint az igazolások benyújtására felhívott ajánlattevőnek az alkalmassági követelményeket az alábbiak szerint kell igazolni: A 321/2015. (X. 30.) Korm. rendelet 21. § (1) bekezdés a) pontja alapján az eljárást megindító felhívás feladásának napjától visszafelé számított három évben (36 hónapban) befejezett, de legfeljebb hat éven (72 hónapon) belül megkezdett legjelentősebb szállításainak ismertetése. A nyilatkozatnak, ill. igazolásnak legalább az alábbi adatokat kell tartalmaznia: - a teljesítés időpontja (kezdő és befejező időpont, év/hónap/nap), - a szerződést kötő másik fél adatai (név, cím/székhely), - a szállított termékek megnevezése (olyan részletességgel, hogy az alkalmassági követelményeknek való megfelelés megállapítható legyen), és mennyisége, - nyilatkozat arról, hogy a teljesítés az előírásoknak és a szerződésnek megfelelően történt-e. Amennyiben a teljesítés nem a szerződésnek megfelelően történt, ismertetni kell az igazolásban vagy nyilatkozatban az eltérés okát és mértékét, valamint a gazdasági szereplő szerződésszegése esetén annak tényét, hogy a gazdasági szereplő szerződésszegésért való felelőssége fennáll-e. Ha az alkalmasság igazolása az ajánlattevő, a részvételre jelentkező vagy az alkalmasság igazolásában részt vevő más szervezet nyilatkozatával történik, a nyilatkozat tartalmazza azt is, hogy a szerződést kötő másik fél vitatja-e a teljesítés szerződésszerűségét vagy – amennyiben a gazdasági szereplő erről nyilatkozott – azt a körülményt, hogy a gazdasági szereplő szerződésszegésért való felelőssége nem áll fenn. Az előírt alkalmassági követelménynek a közös ajánlattevők Kbt. 65. § (6) bekezdés szerint együttesen is megfelelhetnek. Az alkalmasság igazolására a Kbt. 65. § (7), , (11)-(12) bekezdése, 67. § (3) bekezdése., 69. § (11), (11a) bekezdése és a 321/2015. (X. 30.) Korm. rendelet 1. § (7) bekezdése, 22. § (2) bekezdése, 21/A. §-a.
