1. The subject of the contract is the provision of water rescue services in the facility of the Covered Swimming Pool (al. John Paul II 31) and Kędzierzyn-Kozielski Activity Centre "Wodne oKKo" (ul. Mostowa 1) in Kędzierzyn-Koźle in the period from the date of signing the contract, not earlier than from 2 January 2027 to 31 December 2027. 2. The water rescue service will consist in particular of: a) ensuring the safety of persons using pool basins and water facilities, b) providing first aid for pre-medication, including qualified, c) control over compliance with the facility regulations by all users, d) performing all duties of a rescuer, e) observing the regulations of facilities, equipment and fire and health and safety instructions, f) ensuring the continuity of the staffing of rescue stations during the Employer's working hours from the date of signing the contract, but not earlier…

… than from 02.01.2027 to 31.12.2027, from Monday to Sunday, g) taking care of the rescue station and entrusted equipment, preventing all material and personal damage to water facilities and pool basins, h) controlling bathing conditions (water, air, surroundings) and recording hazards in the logbook of on-call duty and the ongoing maintenance of the logbook of the rescue service, i) removing contaminants from the water mirror and from recreational devices located near/in the pool basins, j) ensuring by the Contractor a designated rescuer acting as the Head of the Rescue Team, k) keeping basic documentation, including keeping the Accident Card, the Rescue Labor Journal at individual positions divided by hours. 3. The Contractor will appoint a person responsible for controlling and supervising the correct implementation of the subject of the contract, who will act as the Coordinator. 4. Ensuring safety conditions must be carried out on the basis of the Act on the safety of persons staying in water areas of 18 August 2011 (Journal of Laws of 2023, item 714 i.e.), the Regulation of the Minister of Internal Affairs of 23 January 2012 on the minimum requirements for the number of water rescuers ensuring constant control of the designated water area (Journal of Laws No. Journal of Laws 2022, item 1981) and other legal acts issued on the basis of the above-mentioned Act. The estimated demand for the number of working hours of rescuers during the contract implementation period is about: 32,881 hours. The working hours and their amount referred to above are estimates and, as such, may not give rise to any claims by the Contractor in the course of performance of the public contract. For one hour of rescue, the Ordering Party understands the provision of a rescue service by one person within one hour. Based on the estimated number of rescue hours, the offer price should be calculated. The offer price is used only to compare the submitted offers and select the most advantageous offer, while the settlements will be made according to the actual number of rescue hours on the basis of the unit prices presented in the price form. The estimated number of rescue hours does not constitute an obligation of the Ordering Party to use them during the term of the contract and cannot be the basis for any claims on the part of the Contractor.
