The contractor undertakes to provide services for the export of mixed and separated municipal waste (plastic and metals, paper, glass and bio-waste) generated on the property on which the facility is located. 3. The Contracting Authority is responsible for providing containers adapted to the storage of municipal waste fractions and segregated for task No 1-12. 4. The Contractor is responsible for providing containers adapted to the storage of municipal waste fractions and segregated for task No 13. 5. The contractor is obliged to deal with the waste handed over in a manner consistent with generally applicable law, and in particular with the Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities (consolidated text: Dz. Journal of Laws 2025, item 733, as amended), the Environmental Protection Act of 27 April 2001 (consolidated text: Journal of Laws 2025, item 647, as amended), the Waste Act of 14 December 2012 (Journal of Laws No. Journal of Laws 2023, item 1587, as amended) and implementing acts issued on the basis of relevant statutory delegations. 6. The Contractor should have the appropriate rights required by law, necessary for the performance of the contract in question, and in particular the entries, permits and decisions of the competent authorities to conduct waste management activities and undertakes to have them throughout the duration of the contract and to present them immediately at any request of the Ordering Party. 7. The Contractor undertakes to perform the subject of this contract with due diligence taking into account the professional nature of the services provided by him, in accordance with the provisions of the model contract – constituting Annex 2 to the ToR and the applicable legal provisions. 8. In the case of performance of the service for task No 1-12, the Contractor shall in particular: a) loading of waste by an employee of the Contractor, b) maintaining cleanliness at the place of performance of the service, c) securing the place in terms of health and safety, 9. In the case of performance of the service for task No 13, the Contractor shall in particular: equipping the property with containers; b) loading of waste by an employee of the Contractor; c) maintaining cleanliness at the place of performance of the service; d) safety of the place in terms of health and safety; keeping the containers in a condition that ensures proper storage and aesthetics. 10. The Contractor is obliged to immediately inform the Ordering Party about any changes in the legal status of his company, as well as about the initiation of bankruptcy, arrangement or liquidation proceedings.
