What the buyer is looking for
The Hannover Region is responsible for local public transport in the Hannover Region. Together with other project partners, it has been carrying out the project "ALBUS - Integration of autonomous scheduled buses in the Hanover region" since 2023. The project is funded by the Federal Ministry of Transport. The current authorisation period ends on 31. December 2027 The project aims to procure electric buses with automated or autonomous driving functions and to test them under real traffic and operating conditions. The aim of the project is therefore not only the procurement of vehicles, but in particular their use and testing in local public transport. The vehicles are to be operated by a transport company designated by the Hanover Region. As things stand, ÜSTRA Hannoversche Verkehrsbetriebe Aktiengesellschaft is scheduled to do so. The Hannover Region remains the contracting authority for…

… the present procurement procedure. The subject of the procurement procedure is the procurement of electric buses with automated or autonomous driving functions and their testing, including the necessary operating, support and other services. The procurement of vehicles and the testing of vehicles form a legally and economically related overall service. The safe and approval-compliant testing requires close interaction between the vehicle technology, the automated or autonomous driving function as well as the holder, approval, operation and support tasks to be carried out in the context of the test operation. The contracting authority therefore intends to award these services uniformly to a contractor. Within this single procurement project, vehicle procurement is carried out on the basis of a framework agreement. The services required for the testing of the vehicles are also part of the single procurement project, but are regulated outside the framework agreement on vehicle procurement in a separate agreement for the respective intended and necessary duration of the contract. The details of the technical and functional requirements for the vehicles as well as the services to be provided in connection with the testing will be further specified in the procurement documents of the tender phase. As part of the project, the client initially intends to procure two automated or autonomous electric buses on a binding basis. In principle, these two vehicles constitute the minimum purchase quantity. Procurement shall be financed by means of grants; the eligibility period ends on 31. December 2027. The minimum purchase obligation is therefore subject to the condition that the funds earmarked for this purpose can be called up within the eligibility period. If the funding can no longer be used due to the end of the funding period or for other reasons under funding law for which the contracting authority is not responsible, the obligation to make a minimum purchase shall no longer apply in this respect. As far as vehicles already approved for autonomous operation with a type-approval in accordance with § 1e(4) StVG or a type-approval in accordance with Implementing Regulation (EU) 2022/1426 are not available, the vehicles are currently to be used on the basis of a test authorisation in accordance with § 1i StVG in conjunction with § 16 AFGBV. The vehicles must be suitable and approved for the intended test operation. The framework agreement is intended to provide an opportunity to react to technical and licensing developments during its lifetime. In particular, the customer shall be entitled to exchange the initially procured vehicles for further developed vehicles approved for possible regular operation in accordance with the terms of the contract and, if necessary, to call up another vehicle.
