… consists in comprehensive daily servicing of sanitary facilities, i.e. emptying of drainage tanks, export and disposal of sewage after bathing from container baths, ongoing replenishment of washing agents or, if necessary, disinfectants in soap dispensers, placed above the sinks located in each type of shower containers. Continuous maintenance of appropriate hygiene and cleanliness conditions, consisting in the performance by persons directly performing work in the above-mentioned activities in the manner specified in Article 22 § 1 of the Labour Code of 26 June 1974, in connection with the above, the Ordering Party during the performance of the service requires the employment by the Contractor and / or Subcontractors of all the above-mentioned employees performing the service throughout the duration of the contract under the employment contract. 5. Method of verifying the employment of these people ; During the execution of the Order, at each request of the Ordering Party within the deadline specified in this request, the Contractor shall submit to the Ordering Party one of the following evidences in order to confirm the fulfilment of the requirement of employment under the employment contract by the Contractor or the Subcontractor of the persons performing the tasks indicated in par. 4 activities during the execution of the Order: 1) Statement of the Contractor or Subcontractor on employment on the basis of an employment contract of persons performing activities referred to in the Ordering Party's request. That declaration shall contain in particular: the precise identification of the entity submitting the declaration, the date of submission of the declaration, an indication that the activities covered by the request are carried out by persons employed under an employment contract, together with an indication of the number of those persons, the type of employment contract, the scope of duties and the number of employees, and a sub-signature of the person authorised to submit the declaration on behalf of the Contractor or the Subcontractor; 2) An anonymised copy of the contract/contracts of employment of persons performing the activities covered by the above-mentioned statement of the Contractor or Subcontractor (together with a document regulating the scope of duties, if it has been drawn up) certified as true to the original by the Contractor or Subcontractor, respectively. An anonymised copy of the contract(s) should include: the type of activity performed (position), the date on which the contract was concluded, the type of contract and the length of time worked by the employee; 3) An anonymized copy of the proof confirming the employer's application of employees performing activities for the Ordering Party to social and health insurance.
