… (FIDIC), the first edition of 1999 in Croatian translation issued by the Croatian Consultants' Association, the Croatian Chamber of Civil Engineers and the Association of Construction Consulting Companies (the so-called FIDIC Red Book), which have been amended by the Special Terms and Conditions of the Contract given in the proposal for the contract. ‘Conditions of the Construction Contract for Construction and Engineering Works by Project of the Contracting Authority’, issued by the International Federation of Consulting Engineers (FIDIC), the first edition of 1999 represents one of the most widely codified general terms and conditions for construction contracts, which are applied worldwide. They represent a quality model for regulating the contractual relationship between the Contracting Authority and the Contractor, and in cases of public procurement where the interest of tenderers from other countries can be expected, they ensure a higher degree of competition and the achievement of the purpose of public procurement (best value for money). It is precisely for the sake of their general application throughout the world that they represent a contractual model that is equally known to performers from European Union countries as from other countries. Knowledge of the local legislation governing construction contracts would unduly favour contractors established in the country from which the contracting authority is established. This represents the fundamental reasons for which the contracting authority decided to contract the part of the procurement relating to construction in accordance with the aforementioned Terms and Conditions. In addition, the ‘Conditions of the Construction Contract for Construction and Engineering Works by Project of the Contracting Authority’, issued by the International Federation of Consulting Engineers (FIDIC), first edition 1999, systematically regulates the relations between the participants in the construction, primarily the Contracting Authority, the Engineer and the Contractor, the division of risks, the manner of exercising the rights arising from the contractual relationship, clearly defines the time limits within which certain actions are to be taken, provides for ways of resolving the situations at issue, regulates the manner of extending the time limits for performance, additional payments and generally protects both the Contracting Authority and the Contractor in fulfilling their mutual obligations and exercising their rights. The application of these Conditions further ensures that the contract will be fulfilled within the scope and time limits set and provides the Engineer, as the supervisory authority, with effective mechanisms that can be used to achieve the stated objectives.
