… time of delivery and payment on the part of the Contractor. The proceedings in question are conducted using electronic means of communication. The description of the subject-matter of the contract is contained in Annex 2 to the ToR. The Contractor is obliged to deliver the subject of the contract to the Ordering Party's headquarters (ul. Common Procurement Vocabulary (CPV) code: 38341000-7 Radiation measuring apparatus 38341200-9 Radiation dosimeters The Ordering Party does not allow the submission of partial tenders. Division of the contract into lots: The contracting authority does not divide the contract into lots. Thus, the Contracting Authority does not allow the submission of partial tenders referred to in Article 7(15) of the Public Procurement Act. Pursuant to Article 91(2) of the Public Procurement Act, the Contracting Authority shall indicate in the procurement documents the reasons for not splitting the contract into lots. The contracting authority analysed the possibility of dividing the contract into lots, taking into account technical, organisational, economic and teleological aspects. It was found that the subject of the contract – is not a divisible unit, i.e. it is not possible to purchase it in lots. The description of the minimum requirements of the subject of the contract determines its specific functionality and compatibility of individual components that are an integral part of it, and individual modules do not work independently. Division into lots would therefore not guarantee the proper performance of the subject-matter of the contract. In summary, the contracting authority does not envisage the possibility of dividing this contract into lots, as such division could result in a restriction of competition, excessive technical difficulties or costs of performance of the contract, or the need to coordinate the activities of the various economic operators performing the various lots, which could adversely affect the proper performance of the contract. Above all, however, a possible division of the contract into lots would not increase the involvement of contractors from the SME sector, as well as would not increase competitiveness in the procedure, while the size and value of the subject of the contract is in fact dedicated to contractors from the SME sector and resignation from it should contribute to increasing competitiveness between contractors. The Ordering Party does not allow for the possibility of submitting variants 6. The contracting authority does not provide for: 1) the conclusion of a framework agreement; 2) the possibility of awarding contracts referred to in Art. 1 point 7 of the Public Procurement Act; 3) an on-site inspection or verification by the Contractor of the documents necessary for the performance of the contract, as referred to in Art. 2 of the Public Procurement Act; 4) selecting the most advantageous offer and using an electronic auction; 5) reimbursement of the costs of participation in the proceedings, subject to Article 261 of the Public Procurement Act; 6) requirements for employment on the basis of an employment relationship, in the circumstances referred to in Article 95 of the Public Procurement Act and requirements for the employment of persons referred to in Article 96 par. 2 point 2 of the Public Procurement Act; 7) reservation of the possibility of poverty
