The subject of the contract is the purchase of XRY PRO ULTIMATED software or equivalent software meeting the criteria set out in Annex 3 to the ToR, together with the supply under the ‘NETFORCE-Network for Finansial Crimes Against European Union Enforcement’ project. The Ordering Party plans to purchase 1 piece of this software. The programme’s functions are described in Annexes 3 to the ToR and constitute the contracting authority’s minimum requirements. Failure to meet the minimum requirements will result in the rejection of the tender as inconsistent with the terms of the contract pursuant to Art. 1 point 5 of the Public Procurement Act The Ordering Party requires that the product be brand new, grade I, non-exhibition, free from technical and legal defects, released for free circulation, meet the quality and performance standards indicated by the Ordering Party in Annex 3 to the ToR.…

… The Contracting Authority requires the Contractor to indicate the manufacturer, name, version or other additional data enabling unambiguous identification of the offered product in Annex 1 to the ToR. Failure to enter the manufacturer, name, version or other additional data enabling unambiguous identification of the offered product in the offer form will result in the rejection of the offer pursuant to Art. 1 point. 5 of the Public Procurement Act – as incompatible with the terms of the contract. The contracting authority shall require that the ICT products, ICT services and ICT processes used to perform the contract, whether as main elements or as components, service environment elements or associated solutions, do not include: ICT products, ICT services or ICT processes identified in the recommendation referred to in Article 33(2); 4 of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the basic security interest of the state or an ICT product, the type of which was specified in the decision on the recognition of the supplier as a high-risk supplier, referred to in Article 67b para. 15 of the Act of 5 July 2018 on the national cybersecurity system, as well as ICT services or ICT processes specified in this decision. The contracting authority may, pursuant to Article 257, cancel the procurement procedure if the funds which the contracting authority intended to use to finance the contract have not been awarded to it.
