… 4-Specification of the Terms and Conditions of the Contract (‘the CTS’). 3.The Ordering Party shall send the Contractor the scope and date of performance of the works specified in § 1 by e-mail. 4.The Contractor undertakes to react, i.e. to start work from the notification by the Ordering Party of the need to perform the work included in the description of the order within the period of declared working days counting from the day following the sending of the order to perform the work by the Ordering Party. 5.The Contractor shall immediately after accepting the order inform the Ordering Party by letter delivered to the Ordering Party or by sending a message to the e-mail address of the Ordering Party's representative about any circumstances known to him preventing or hindering the execution of the order. 6.The Contractor is obliged to follow the instructions and instructions of the Ordering Party. 7.The Contractor will be required to deliver the resulting waste to Wielkopolskie Centrum Recyklingu – a limited liability company in Jarocin (Witaszyczki, ul. im. Mariusz Małynicza 1, 63-200 Jarocin) or to manage it on his own responsibility in accordance with the law. Costs related to the management of waste generated during the works will be covered by the Contractor. 8.The Contractor shall ensure access/supply of water for irrigation purposes and shall bear all costs related thereto, with the exception of water supplied to the drip irrigation line, which shall be provided by the Ordering Party. The Contractor is responsible for the operation of the irrigation system (applies to the part of the area marked 2 and 6 in Annex 2 and Annex 3). 9. The Ordering Party shall not impose on the Contractor a specific method of irrigation of plants, but they must be accepted in writing by the Ordering Party. 10.The Contractor bears the costs of necessary tests (e.g. soil tests) or the purchase of tools necessary for the performance of the contract, e.g. the purchase of fertilizers, with the exception of mulching material, which will be provided by the Ordering Party at its own expense. 11.The Contractor will be obliged to perform the works that are the subject of the contract in accordance with the currently applicable law (in particular the Nature Conservation Act), current technical and horticultural knowledge, due diligence and on the basis of applicable standards and in accordance with the guidelines of the Ordering Party. 12.The Contractor bears full responsibility for improper compliance with the Ordering Party's recommendations, which will cause damage or destruction of greenery. 13.The Contractor is responsible for the proper marking and securing of the work carried out and for introducing changes in the organization of traffic in connection with the work carried out. 14.Conducting works must not cause nuisance to bystanders and endanger the safety or life of persons, e.g. by storing waste on sidewalks and streets. 15.The Contractor bears full responsibility for the proper performance of work on the subject of the contract, ensuring health and safety conditions and organizational and technical methods, as well as is responsible for damage and consequences of accidents affecting employees and third parties, and arising in connection with the work carried out under this contract, is also responsible for fire protection. 16.The Contractor is obliged to bear liability for damages
