The contracting authority reserves the right to cancel the procedure on the basis of Article 257 of the Public Procurement Act in the event of failure to award public funds intended to finance all or part of the contract until the end of the procedure for awarding the public contract. 4. The subject of the contract must have certificates, attestations and authorisations for use in the activities of the Ordering Party in accordance with Polish law. The Contractor is obliged to verify the documents provided in terms of legality and compliance with the actual legal situation. The subject of the contract must be brand new, equipment manufactured in 2026, unused, not subject to exhibitions, scientific research, development works, research services, not subject to demonstration and reconditioning, previously not used for any purpose by another entity, released for marketing and use in the Republic of Poland in accordance with applicable law; complete devices, ready for use after installation without the need for supplementary purchases.
