1. The subject-matter of the contract is the supply of brand new spring suspension elements for Metropolis 98B wagons in the years 2028-2030 (hereinafter also referred to as ‘parts’). 2. The scope of the subject of the contract includes the delivery of parts divided into 3 tasks. The names and quantities of the lots for each task are set out in the ‘List of lots to be procured’ attached as Annex 1 to the Technical Specifications (hereinafter: ‘ST’), which forms Annex 1 to the FTZ and forms an integral part thereof. 3. The Ordering Party requires the completion of the Subject of the Order in batches, according to the delivery schedule and in the quantities indicated in Annex 1 to the ST. … use). 5. For the delivered parts, the Contractor will provide a 36-month guarantee under the conditions indicated in the model contract. For a period equal to the period of warranty granted by the Contractor, the subject of the contract will be covered by a warranty for defects. 6. The subject of the Order will be carried out in accordance with the documentation of the procedure, i.e.: this FTZ and its annexes, in particular ST and the model contract (Annex 2 to the FTZ). 7. The Ordering Party does not have the possibility to describe the Subject of the Order in the manner referred to in Art. 4 of the Public Procurement Act, i.e. without the indication of trademarks, therefore the spring elements of the suspension specified in Annex 1 to the ST were described using the part manufacturer's / subway vehicle manufacturer's catalogue numbers in which the part was installed. The use of the manufacturer's catalogue numbers is justified by the specificity of the subject of the Order. Considering the above circumstances, in accordance with Art. 5 of the Public Procurement Act, the Ordering Party allows the submission of an offer for products equivalent to those indicated by the Ordering Party. Where equivalent parts are offered: 1) they must have the same parameters as the original parts, while complying with the functional requirements of the original parts and be compatible with other vehicle components, 2) the use of equivalent parts must not result in a high risk of change, which means that changes resulting from the use of equivalent parts must be reversible and in the event of a failure generate low consequences of failure, 3) the Contracting Authority requires that the manufacturer of equivalent parts has implemented a Quality Management System in his company, 4) the Contractor is responsible for the risk of their entry into service and for defects in the equivalent parts offered. Contractor who offers to supply equivalent parts: - declare in the tender form that it offers and will supply equivalent parts, - indicate in the tender form the items from Annex 1 to the ST for which it offers equivalent parts, - include in the tender form the data of the equivalent parts offered, i.e. the names of equivalent parts, manufacturers of equivalent parts, catalogue number/identification of equivalent parts, while it is the Contractor's responsibility to describe the equivalent parts offered in the tender in a way that allows the Ordering Party to unambiguously determine which equivalent parts the Contractor offers in a given item of the tender form, - together with the tender will provide the evidence in question, i.e.: a copy of the certificate of implementation of the Quality Management System, issued by the accreditation body, for the manufacturer of the equivalent parts offered, in accordance with point 2.3(b) ST of point 2; a copy of the assessment of the significance of the change (on its own and at its own expense) concerning the equivalent parts offered. The result of such an assessment must be that it is classified as a non-substantial, non-safety-related change.
