… 1 to the FTZ – Description of the subject-matter of the contract. 4. In addition, the detailed scope of the contract was specified in the Functional and Utility Programme and the other annexes constituting annexes to the FTZ. 5. The Contracting Authority shall not require the Contractor to carry out an on-site inspection or to check the documents necessary for the performance of the contract on the spot with the Contracting Authority. 6. The task is co-financed by the Government Fund of the Polish Deal: Programme of Strategic Investments. 7. The Contractor may confine himself to completing Section α of Part IV of the European Single Procurement Document (ESPD) and does not have to complete any of the other sections of Part IV of the ESPD. 8. The Contractor pursuant to Art. 1 of the PPL Act will be obliged to: 1) Employment by the Contractor or Subcontractor on the basis of an employment contract of persons performing activities in the field of contract performance, the performance of which consists in the performance of work in the manner specified in Article 22 of the Act of 26 June 1974 - Labour Code (consolidated text: Journal of Laws of 2017, No. Journal of Laws 2023, item 1465) the following: - demolition works, - earthworks, - assembly works, - construction works, - capture technology; The Employer requires that persons performing the activities referred to above in the framework of the employment relationship between them and the employer provide it in person, at the place and time indicated by the employer, under his direction with subordination to the service, for remuneration, with the right to leave. 2) Providing the contracting authority on the date of commencement of the contract with a list of persons who will perform the activities referred to in point. 1) during the execution of the order. This list in case of change of the person(s) performing the activities referred to in point. (1) It shall be promptly updated at all times. 3) In the case of entrustment by the contractor of the part of the contract covering the performance of the activities referred to in point. 1) for the subcontractor, the obligation to employ persons performing these activities on an employment contract will also apply to the subcontractor. 4) During the performance of the contract, the contractor (subcontractor) at the request of the contracting authority shall provide evidence confirming the employment of persons referred to in point. 8(1) to (3). 5) In the event of non-compliance by the contractor (subcontractor) with the obligations referred to in point. 8 points. 1-3, the contracting authority provides for sanctions in accordance with the model contract attached to the FTZ. 6) The above requirement does not apply to the construction manager/works because, in accordance with Article 12 of the Construction Law, activities involving the management of construction or other construction works may be performed by a person performing an independent technical function in the construction industry. Only persons with building qualifications can perform an independent technical function in construction. Building rights are granted by name. Therefore, it is not required to establish an employment relationship under the direction of the employer to manage the construction works.
