Procurement documents Steel construction works - Overview of suitability requirements, scope of services and terms of contract
The texts concern an EU-wide procurement procedure for construction services (steel and metal construction works) under the VOB/A in Germany, with reference to German procurement forms (VHB Bayern) and German construction and procurement law.
The place of performance is Nuremberg (Germany), the procurement platform is "meinauftrag.rib.de", and reference is made expressly to German regulations (GWB, VOB/A, VOB/B, Minimum Wage Act, AEntG, EStG, etc.).
This is a national German perspective within an EU procurement procedure.
With regard to the documents and minimum requirements to be submitted, the procedure stipulates that the tender must be submitted via the electronic procurement platform and in German.
The tender must use the standard forms, in particular the tender letter (213.H), the completed price schedule and the information on pricing (forms 221 or 222), the declaration of reference to Russia (127), the offer on the wage slip clause (224, if offered), any declarations on the consortium (234), subcontractor services (233) and services/capacity of other companies (235), as well as the declarations on wood products and on-site plants (248/2481) and child labour (2491).
Non-prequalified companies must submit the self-declaration of suitability (FB 124) or an ESPD; prequalified companies shall provide their PQ number.
As required, for example, turnover data for the last three financial years must be provided for comparable services, information on the availability of the workforce, registrations (commercial register, trade register, IHK), membership of the trade association and the declaration of proper payment of taxes, levies and social security contributions; shortlisted, these self-declarations are confirmed by supporting documents (commercial registration, HR extract, crafts card/IHK certificate, qualified safety certificates from the tax office, social security fund, trade association, exemption certificate § 48b EStG, reference documents, information on average staff, data of the managing directors, if necessary proof of self-cleaning).
With regard to the scope of services, the documents describe that steel and metal construction work must be carried out for two adjacent buildings, with concrete quantities such as approx. 170 m2 of grating levels in technical shafts, approx. 500 m of steel and glass railings with handrails, three canopies as clad steel structures, 76 steel sheet doors, three steel staircases and a steel grandstand structure for a lecture hall.
As regards the award criteria, it is clarified that the price is the only award criterion; the evaluation is carried out on the basis of the recalculated tender sums including any discounts, reimbursement amounts from the wage slip clause and maintenance offers.
As explained therein, several main offers are not allowed (according to the notice), ancillary offers are explicitly not allowed; accordingly, point 4 of the conditions of participation in ancillary offers does not apply here.
For the ‘acceleration control award criterion’ in Form 216, however, it is provided that the tender must be accompanied by a binding end date (date or working days) and a detailed construction schedule; this information is used for evaluation within the framework of the predetermined price evaluation or the contract periods, without being shown as a separate quality criterion next to the price.

The special risks and contractual conditions include, in particular, contractual penalties for exceeding the deadline in accordance with § 11 VOB/B, securities and regulations on subcontracting.
For example, penalties are provided for each working day of delay in individual deadlines or the total completion period, up to a limited percentage of the contract amount; Penalties forfeited shall be aggregated and credited.
With regard to securities, the publication text states that, for orders with a net value of EUR 250,000 or more, a contract performance guarantee of 5% and a warranty for claims for defects of 2% of the advance payments must be provided at the time of acceptance; on the other hand, the Special Terms and Conditions first state that ‘guarantee for performance of the contract/defect claims shall be waived’, followed by an entry ‘Insofar as the amount of the contract is at least EUR 250,000 ..., security ... shall be lodged’, so that it can be seen that the percentage actually filled in (here from the contract notice: 5% / 2%) and the phrase ‘will be omitted’ is only standard placeholder text.
This is what is relevant here: electronic submission is mandatory, several main tenders are not accepted, variants/ancillary tenders are not accepted, guarantees of 5% (performance of the contract) and 2% (defects) are required, price is the only award criterion.
According to No. 1 of the EU Terms and Conditions of Participation, any ambiguities or detected contradictions must be communicated in text form via the procurement platform immediately before the tender is submitted, so that the contracting authority can clarify them by means of change notifications.
Only the contracting authority's tender documents are binding. As of: 29/10/2026
