Public tender for framework contracts for office and file removals in Schleswig-Holstein
The input text concerns a German public procurement procedure conducted by Gebäudemanagement Schleswig-Holstein AöR (GMSH) for framework contracts covering office, small and file removals and related services.
It is an EU‑wide tender (falls under the WTO GPA) but funded from non‑EU funds, and all documents and communication are in German.
The background is that GMSH intends to conclude one framework agreement per lot for move‑related services, such as office and file removals, transport, storage, clearance, disposal, assembly and disassembly.
The procedure is an open procedure under § 52 VgV with electronic submission via the e‑Vergabe platform “meinauftrag.rib.de”.
The tender is structured in lots (for example, lot 2 Lübeck with a stated framework value of 2,001,000 € net) and is explicitly considered suitable for SMEs, with the possibility of bidding consortia (Bietergemeinschaften).
Regarding what bidders must submit and minimum qualification, the documents specify several mandatory declarations and forms.
Such as: an Eigenerklärung that the company is entered in a professional or commercial register (or equivalent proof) as required by § 44 VgV; information on total turnover and turnover specific to the service being tendered for the years 2023, 2024 and 2025; an Eigenerklärung that an appropriate business liability insurance (Betriebshaftpflichtversicherung) exists or will be concluded as per § 45 Abs. 1 Nr. 3 VgV; between three and five references for comparable services performed essentially in the last three completed years (2023–2025), to be provided using the reference form; a concise presentation of the bidding company including service portfolio (max. 4 DIN A4 pages); and an Eigenerklärung that the Wettbewerbsregister contains no negative entries, noting that GMSH will obtain an official register extract before award.
For subcontracting and use of other companies’ capacities, bidders must submit a “Verzeichnis der Unterauftragnehmerleistungen” listing subcontracted services and firms, a Verpflichtungserklärung anderer Unternehmen (form) proving the availability of capacities, and a specific declaration (form) stating whether the bidder intends to award subcontracts, which must be attached even if no subcontracting is currently planned.
Bietergemeinschaften must provide a joint declaration naming all members, a lead partner and confirming joint and several liability, and every member must sign the offer and submit the required evidence.
Concerning the scope of the contract (what, how much, where, when), the measure is titled “Rahmenverträge für Büro-, Klein- und Aktenumzüge, Umstell- und Transportarbeiten, Einlagerung, Entrümpelungs- und Entsorgungsleistungen, Montage und Demontage.” The contract type is services (CPV 98392000 Moving services).
The place of performance is “beliebiger Ort” with additional information “Deutschland, Schleswig-Holstein,” meaning moves and related services within that state (including specific locations such as Lübeck and Kiel).
The framework agreement duration is from 01.01.2027 to 31.12.2028, with automatic annual renewal up to two times unless the contracting authority objects at least three months before the end of a contract year; thus a maximum overall term until 31.12.2030.
Show all 25 statements
For at least one lot (Lübeck) the maximum framework value is 2,001,000 € net, and there is a maximum of one participant per framework (no multi‑supplier framework).
The detailed quantities and service specifications are in the Leistungsverzeichnis/Leistungsprogramm (price list and service description) which must be filled in Excel format and submitted with the offer.
Award criteria and weighting are clearly defined and purely MEAT‑based with price and qualitative environmental aspects.
Discounts are only considered if they are unconditional percentage reductions on the settlement sum and indicated at the designated place in the offer letter; non‑evaluated discounts still become part of the contract.
Variants (Nebenangebote) are not permitted in this procedure according to the tender notice and the specific Angebotsaufforderung, despite general rules on Nebenangebote in the Bewerbungsbedingungen.
Risks and special conditions include several contractual and procedural features.
Such as: the general contract conditions VOL/B (Ausgabe 2003) and the “Zusätzliche Allgemeine Vertragsbedingungen” of GMSH become part of the contract, and any bidder’s own general terms and conditions will be treated as a change to the tender documents and lead to exclusion.
The additional conditions also regulate packaging and transport costs (included in the prices), take‑back and disposal of packing material, and liability for overpayments (repayment within 14 days plus 8 percentage points interest over the base rate).
The offer must be in German, submitted electronically via the platform, in text form or with the required electronic signature; bids in other languages need certified German translations for certificates.
On contradictions or corrections within the documents, a few points stand out and require careful handling.
Such as: the Bewerbungsbedingungen contain general provisions on Nebenangebote (how to mark and describe them) but the specific Angebotsaufforderung states “Nebenangebote sind nicht zugelassen,” and the TED notice confirms “Varianten: Nicht zulässig”; the specific restriction in the Angebotsaufforderung for this measure takes precedence, so bidders must not submit variants.
Another tension arises between the Anlage „Vorzulegende Nachweise“ and the eForms/TED text regarding which documents must be submitted with the offer and which only on separate request; the annex lists items 6–14 (including insurance declaration, references, company presentation, Wettbewerbsregister declaration, subcontractor forms and the filled Excel files) under “auf gesondertes Verlangen,” whereas the TED notice describes several of these (especially 12–14) as to be submitted “mit dem Angebot.” In practice, the safe approach is to treat all items expressly mentioned in TED as required with the offer (Leistungsverzeichnis, Fuhrpark and Karton/Mehrwegbehälter Excel forms, subcontractor declaration, etc.), follow the stricter interpretation of the Angebotsaufforderung, and if any doubt remains, use the ad‑hoc communication channel on the platform to request clarification from GMSH before the question deadline.
Where the Bekanntmachung and the detailed tender documents conflict, German case‑law generally gives primacy to the detailed tender documents, but bidders are obliged under the Bewerbungsbedingungen to point out perceived ambiguities “unverzüglich” before submitting their offer.
Only the contracting authority's tender documents are binding. As of: 25/10/2026
