Vergabeunterlagen für Stahlbeton- und Abdichtungsarbeiten in Jagel (NATO-Flugplatz)

The input text comprises the standardised German VHB/VOB forms and project‑specific conditions for a public construction tender by Gebäudemanagement Schleswig‑Holstein AöR (acting for the Bundesrepublik Deutschland).

It sets out how bids are to be submitted via e‑Vergabe, what technical and contractual rules apply, and how the contracting authority will assess and award a contract.

The perspective is clearly that of German public procurement law (VOB/A, VOB/B), with references to national regulations on security (SÜG, Geheimschutz) and to NATO-related infrastructure on German territory.

In terms of what the bidder must submit and minimum qualification, the documents specify that the bid must use the provided German forms and be submitted electronically by the deadline.

As such, additional forms are only required where applicable: for instance, Form 233 (Nachunternehmerleistungen) if parts of the work are subcontracted, Form 234 for a bidding consortium, Form 235 if capacities of other companies are used, and Form 248 for timber use.

For non‑präqualifizierte bidders, Form 124 (Eigenerklärung zur Eignung) must be provided as preliminary proof of suitability, including turnover for the last three years and a declaration of comparable works in the last five years.

If a bid comes into closer consideration, the bidder must on request substantiate this with references, social fund and tax “Unbedenklichkeitsbescheinigungen”, Freistellungsbescheinigung under § 48b EStG, and proof from the Berufsgenossenschaft; präqualifizierte firms instead give their PQ number and provide any additional project‑specific proofs required.

Regarding scope of the contract and performance framework, the tender concerns “Stahlbeton‑ und Abdichtungsarbeiten” for an LAU‑Anlage (Auffang-/Ausblutebecken) at FlPl Schleswig, Jagel (NATO‑Flugplatz, Abstellhalle Kanalreinigung).

The Bekanntmachung lists main quantities, such as approx. 50 m³ WU‑Beton, 80 m² Schalung and 15 m PP‑Grundleitungen, but the full Leistungsverzeichnis governs all details.

On award criteria and weighting, the Aufforderung zur Angebotsabgabe states that the sole substantive Zuschlagskriterium is the price, determined as a “Wertungssumme” derived from the checked offer sum while considering discounts, any labour price adjustment (Lohngleitklausel) and maintenance offers.

As such, the documents mention that more than one award criterion could be used “gemäß Formblatt Zuschlagskriterien”, but for this tender only price is actually activated.

A specific preference is introduced for workshops for disabled persons: if an offer from such a workshop is equally economical compared to a competitor, it receives the award, and a 15% bonus on the value sum is granted in the evaluation.

The bidder must prove the status as a Werkstatt für Behinderte with the offer.

The documents lay out several risks and special conditions.

There is an obligation to obtain and use Erlaubnisscheine for all “Heißarbeiten” (welding, cutting, etc.), with non‑compliance potentially affecting rights.

For guarantees, a performance security of 5% of the gross contract sum is required where that sum reaches at least €250,000, and a 3% security for defects based on total interim payments at acceptance, both typically via specified standard surety forms.

On subcontracting, the participation conditions require the bidder to declare in the offer whether all services are performed in-house or which parts are allocated to Nachunternehmer; form 233 must be used if subcontracting is planned, and later, detailed safety and commitment declarations (Forms 126, 236) may be requested.

Bietergemeinschaften must provide a joint declaration that they will form an ARGE, name a duly authorised representative, and accept joint and several liability.

There is explicitly no physical bid opening with reading of prices due to full electronic handling, and no site visit rules beyond general access and security requirements at the NATO base.

Regarding contradictions or corrections, the documents mostly cross‑reference standard forms without obvious conflicting statements.

Where apparent overlaps exist, such as between the Aufforderung (Form 211), Bekanntmachung (Form 121) and Verzeichnis der Unterlagen (Form 216) on which documents are to be submitted and whether missing documents are “nachzufordern”, the more specific entries apply: the Bekanntmachung states that all documents demanded with the offer (except missing price data) can be requested later, and Form 211 confirms that “Alle Unterlagen … mit Ausnahme fehlender Preisangaben” are subject to post‑request.

Likewise, although Form 211 lists a larger set of potential forms under section C, Form 216 refines which of these are actually required in this procedure (e.g. price calculation forms 221/222 are listed as possible but are not checked as mandatory here).

Statements that the Langfassung of the Leistungsverzeichnis is binding resolve any ambiguity with self‑made short versions.

Tactics

This procedure allows 42 days between publication and deadline — typical in this country is 32 (median of 20,496 procedures). Much more generous than usual — time for a thorough bid rather than a quick one.

Foreign bidders

In Germany, 6,022 contracts went to foreign companies over the last 3 years (of 725,088 recorded awards) — mostly from Austria, Poland, Italy.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
