… 101 of the Public Procurement Act, allows the submission of ‘equivalent products or solutions. All ‘products from specific manufacturers shall specify the minimum quality parameters and performance characteristics to be met by ‘, products in order to meet the requirements set by the Contracting Authority and shall constitute only a quality standard for the subject-matter of the contract. By the provision regarding the minimum requirements of quality parameters, the Ordering Party understands the requirements of goods contained in generally available sources, catalogues, manufacturers' websites. Operating with exemplary manufacturer's names is only aimed at clarifying the level of the Ordering Party's expectations in relation to a specific solution. Thus, the use of the names of producers / products / is only exemplary. The Ordering Party, when describing the subject of the contract, indicating the designation of a specific manufacturer (supplier) or a specific product, simultaneously allows equivalent products with quality parameters and performance characteristics, at least at the level of the parameters of the indicated product, thus recognizing each product with the indicated parameters or better. In such a situation, the Ordering Party requires the submission of relevant documents that authenticate these materials or devices. 5. Required warranty period: 10 years from the date of signing the ‘Protocol for acceptance of the subject matter of the contract without significant remarks’. The duration of the guarantee and warranty period results from the requirements set out in the grant agreement for the procedure in question and may not be shortened. 6. NOTE: The contracting authority reserves the right to cancel the procedure pursuant to Article 257 of the Public Procurement Act if the public funds which the contracting authority intended to use to finance all or part of the contract have not been granted to it. 7. The Contracting Authority intends to allocate PLN 120 000.00 (gross amount) to finance the subject matter of the contract.
