… the effects of sending the letter (Article 17 of the Postal Law - the power of delivery), in particular as set out in the following provisions: 1) Article 57 § 5 point. 2 of the Code of Administrative Procedure; 2) Article 165(2) of the Code of Civil Procedure; 3) provisions of other legal acts relating to the sending of parcels with the effect of meeting the deadline or submitting a letter to the court / public administration body. 4. The data specified in Annex 1A to the tender specifications relating to the number of consignments/services are estimates and do not constitute an obligation on the part of the Contracting Authority to send consignments in the quantities indicated. The specific types and number of individual types of shipments as part of the services provided may change depending on the needs of the Ordering Party. A reduction (minimum amount of service guaranteed by the Ordering Party - 70%) or an increase in the number of shipments does not constitute an amendment to the contract. The Contractor shall have no claim against the Contracting Authority in the event that the estimated quantities of consignments/services (as set out in Annex 1A to the tender specifications) are not fully used by the end date of the contract. The Ordering Party shall pay the Contractor only for the services actually performed. 5. Common Procurement Vocabulary (CPV) names and codes: 64110000-0- postal services 6. When performing the contract, the Ordering Party allows the use of equipment and materials equivalent in quality and raw materials used for their execution to the materials and devices specified in the procurement documents (SWZ and annexes). 7. If the commercial name of the company, goods or product is indicated in the procurement documents (the tender documents and their annexes), the Ordering Party - in relation to the parameters indicated directly in the procurement documentation, or data (technical or any other) identifying directly or indirectly the goods or products - accepts equivalent solutions in accordance with the technical data and parameters contained in the above-mentioned documentation. Equivalent solutions should be understood as solutions with parameters not inferior to those required but included in the documentation. 8. Wherever reference is made to Polish Standards in the procurement documents (the tender documents and annexes), it is permissible to apply the relevant standards of the European Union countries, to the extent adopted by Polish legislation. 9. Wherever the procurement documents (the CMS and its annexes) indicate trade marks, patents or origin in the description of the materials or equipment used, it is accepted that equivalent materials or equipment may be used. The indication of the trade mark, patent or origin shall be for illustrative purposes only and shall be used to specify the quality and class standards required for the materials or equipment used. Where the standards and regulations referred to are national or refer to a particular country or region, other appropriate standards ensuring an equal or higher level of performance than the standards or regulations referred to may also be applied.
