… describes the subject-matter of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Article 101 of the Public Procurement Act, it shall allow solutions equivalent to those described. The contractor who refers to solutions equivalent to those described by the contracting authority is obliged to demonstrate in the tender that the proposed solutions meet in an equivalent manner the requirements set out in the description of the subject of the contract. 3.5. In cases where trade marks, patents, origin, source or a specific process characterising specific products or services are indicated in the description of the subject-matter of the contract, this means that the Ordering Party cannot describe the subject-matter of the contract with sufficiently precise terms and this is justified by the specificity of the subject-matter of the contract. In such situations, any indications of trade marks, patents, origin, source or specific process should be read with the words ‘or equivalent’, whereby the criterion used to assess equivalence is to meet at least the same characteristics (qualitative and usable) and technical parameters at a level at least as indicated by the Contracting Authority in the description of the subject-matter of the contract. 3.6. The Contractor is obliged to perform the order on the terms and conditions described in this tender specification and in the annexes to the tender specification.
