… The Contracting Authority shall require the Contractor to sprinkle the roads simultaneously by snow removal if there is a need for sprinkling. 8. Material for combating embellishments shall be provided by the Contractor in the form of materials: sand, unsorted aggregate with a grain size of up to 4 mm, road salt. 9. Wherever terrain and weather conditions so require, the contractor will equip the equipment used to perform the service with chains on wheels. 10. The Ordering Party shall not be liable for damage caused by the Contractor during the performance of the service. 11. 24-hour availability is required, the need to have a mobile phone both by the person operating the equipment, i.e. snow removal (phone in the tractor cabin) and the person coordinating snow removal at the Contractor. 12. The dates of snow removal of roads will depend on weather conditions and information provided by the Head of the Investment Department, and by the mayor of a given parish, but not later than within 60 minutes from the call for snow removal (for each part of the subject of the contract). 13. The Contractor, within 5 days from the date of signing the contract, will be obliged to provide a hardware unit for the installation of the GPS device provided by the Ordering Party. The terms of payment and the guaranteed amount for the performance of the service are described in detail in the draft contract constituting Annex 5 to the ToR. 15. It is recommended that the Contractor carry out an on-site inspection of the area of performance of the contract. Carrying out a verification is not a condition for submitting a tender in the present proceedings. The costs of the on-site visit shall be borne by the Contractor. 16. The Contractor shall comply, inter alia, with the following provisions: a) the Road Traffic Act of 20.06.1997 (i.e. Journal of Laws 2024, item 1251), (b) the Public Roads Act of 21 March 1985 (i.e. OJ Journal of Laws 2025, item 889 ), c) Act of 14 December 2012 on waste (i.e. Journal of Laws 2023, item 1587 ), d) Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. OJ U. of 2025, item 733 ) e)Regulation of the Minister for the Environment of 27 October 2005 on the type and conditions of application of measures that may be applied on public roads, streets and squares (Journal of Laws No. U. No. 230items. 1960) 17. After the winter season, i.e. after the end of the provision of services related to winter road maintenance, the Contractor is obliged to clean up materials that are used to sprinkle roads on the date indicated by the Ordering Party. 18. The requirement of employment on the basis of an employment relationship requires employment by the Contractor, a subcontractor or a further subcontractor on the basis of an employment relationship of persons who will perform activities related to the snow removal service, including persons driving vehicles used directly to combat slipperiness. Detailed requirements for the implementation of the obligation referred to above, the method of verifying the employment of persons on the basis of the employment relationship, the power of the Ordering Party to control compliance by the Contractor, subcontractor or further subcontractor related to the employment of these persons and the penalty for non-compliance
