… Ordering Party, will provide services on working days, i.e. from Monday to Friday, i.e. 5 days a week from 7:00 to 21:00. 4. Duration of services: 1 hour of service equals 1 clock hour, i.e. 60 minutes. 5. The concept of the number of hours of services provided should be understood only as the actual time of providing services without preparatory activities, i.e. without the time needed to reach or travel. If the Ordering Party's order provides for the provision of services by two persons at the same time (§ 3 sec. 4 of the Regulation of the Minister of Family, Labour and Social Policy of 4 August 2026 on care services at the place of residence), the working time of each of these persons is settled. In other cases, the provision of a service by more than one person does not increase the number of hours charged. 6. The number of hours may change because it cannot be determined precisely due to the specificity of the contract, which is characterized by the variability of needs due to the changing state of health and life situation of people in need of assistance. 7. The Ordering Party reserves the right to reduce the number of hours of care services provided depending on actual needs and financial capabilities. The remuneration payable to the Contractor will be determined on the basis of the gross price of 1 hour of care services specified in the tender. Quantitative changes in the hours and a reduction in the value of the contract do not require an annex to the contract within the limits specified in § 5 sec. 3 of the model contract. As part of the offer price, the Ordering Party reserves the right not to use the entire number of hours ordered, but guarantees the ordering of services with a value of not less than 70% of the contract value (minimum amount of service within the meaning of Article 433(4) of the Public Procurement Law). The Contractor shall be entitled to remuneration for the number of hours of services actually provided and shall not make any claims as to the performance of the remaining part not commissioned by the Ordering Party. 8. The monthly number of hours of services provided will depend on the type of services, the number of charges and their needs and will change during the term of the contract. Due to the specificity of the subject of the contract, the Ordering Party reserves the right to significantly change the number of people using care services during the term of the contract. The number of hours of service may be changed, in particular, in the case of: - changes in the number of hours in the administrative decision, e.g. due to a change in the state of health of a given ward, by increasing or decreasing the number of hours, - repeal or expiration of the decision granting the right to care services, - absence of the ward (stay in hospitals, rehabilitation, departure to the family), - changes in the decision on the date of providing care services at the request of the ward. 9. The subject of the contract includes the provision of care services for people who, due to age, illness or other reasons, are unable to meet everyday life needs, hygienic care, care ordered by a doctor and provide contact with the environment, as well as for people who require the help of other people, and the family cannot provide such assistance. 10.
