… performance of the contract are also specified in the draft provisions of the contract, constituting Annex 6 to the ToR. 5. Where the Contracting Authority has described the subject-matter of the contract in the description of the subject-matter of the contract by indicating the trademarks, patents or origin, source or specific process that characterises the products or services provided by a specific Contractor, it should be understood that equivalent solutions are permitted. The use of exemplary manufacturer names is only aimed at clarifying the level of expectations of the Ordering Party in relation to a specific solution. Thus, the use of the names of producers or products is purely illustrative. When describing the subject of the contract, indicating the designation of a specific manufacturer (supplier) or a specific product, the Ordering Party at the same time allows equivalent products with quality parameters and performance characteristics, at least at the level of the parameters of the indicated product, thus recognizing each product with the indicated parameters or better. ‘Parameters’ means functionality, purpose, materials, shape, size, safety and strength. All ‘products’ from specific manufacturers define the minimum quality parameters and performance characteristics that ‘products’ must meet in order to meet the requirements set by the contracting authority and constitute only a quality standard for the subject-matter of the contract. 6. Whenever the Contracting Authority describes the subject-matter of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, it shall accept solutions equivalent to those described. Other information in this respect is contained in Chapter III of the ToR.
