… (Annex 3 to the tender specification). 2. Pursuant to Article 101(1) CTMR, 4 of the Public Procurement Act in the event that the annexes to the tender specifications, i.e. the draft contract or the description of the subject-matter of the contract, contain a reference to the standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Article 101(1) CTMR. 1 point 2 and par. 3 of the Public Procurement Act, and such references were not accompanied by the expression ‘or equivalent’, it should be assumed that each: the standard, the European Technical Assessment, the approval, the technical specifications, the technical reference system appearing in the description of the subject-matter of the contract shall be accompanied by the words ‘or equivalent’. 3. The provisions of the Act of 5 August 2025 on the certification of public procurement contractors (i.e. OJ Journal of Laws 2025, item 1235 as amended). Detailed information is contained in the ToR.
