The subject of the contract delivered to the Ordering Party will be brand new, free from legal and manufacturing defects and will comply with the recommendations, standards and applicable technical and operational requirements in the Republic of Poland. … Ordering Party with technical and operational documentation or instruction manuals in Polish. The acceptance of the subject of the contract will consist in checking the condition of the subject of the contract and confirming the completeness of the equipment and equipment. If defects, defects and deficiencies that cannot be remedied are found during collection, the Ordering Party may refuse to accept the subject of the contract in whole or in part affected by these defects, defects or deficiencies, setting a deadline for their removal. In this case, the acceptance protocol will indicate the unclaimed subject of the contract with an indication of the date of delivery of the subject of the contract free of defects, defects and deficiencies, not longer than 7 calendar days. In such a situation, the Contractor shall be deemed to be in default of performance of the contract and shall be obliged to pay the contractual penalties referred to in § 7 para. 2 (b) of the model contract, if the time limit specified in paragraph 1 has been exceeded. 1 above. If defects, defects and deficiencies are found during the acceptance process, the Ordering Party shall set a deadline for their removal by the Contractor. After the Contractor has removed defects, defects and deficiencies that can be remedied at his own expense, the Contractor shall notify the Ordering Party that they have been removed, and the Ordering Party shall collect them after confirming the correct performance. The cost of transport, insurance during transport shall be borne by the Contractor. A detailed description of the subject of the contract is contained in the Description of the subject of the contract constituting Annex 6 to the ToR. The terms of performance of the contract shall be determined, as appropriate, by: description of the subject-matter of the contract (Annex 6 to the tender specification) and draft provisions of the contract – model contract (Annex 7 to the tender specification).
