1. The subject of the contract is the supply of equipment for the needs of the AOS multi-specialist municipal hospital named after Józef Struś in Poznań. The subject-matter of the contract shall cover, as appropriate, inter alia: delivery, bringing, assembly, connection and commissioning of the subject-matter of the order in accordance with the expectations of the ordering party. 2. A detailed description of the subject of the contract is attached as Annex 1 to the ToR. 3. Whenever in this text of the ToR, as far as the description of the subject of the contract is concerned, we refer to trademarks, proper names, etc. – they constitute only a qualitative, functional, technical and technological standard relating to the subject-matter of the contract. In all cases where, due to the specification of the subject of the contract, the names of materials, devices or their origin are indicated, it is permissible to use equivalent materials, devices, i.e. any materials mentioned by name, devices used in the documentation provided by the Ordering Party or their origin, serve only to determine the standard and may be replaced by other not inferior technical, functional, quality and aesthetic parameters, taking into account the proper cooperation with other materials, devices. The names used in the investigation documents, which indicate or could be associated with the manufacturer or company, are not intended to give preference to the solutions of a given manufacturer, but to indicate a solution that should have technical, technological characteristics not inferior to those given in the technical documentation. In the case of tenders containing equivalent solutions, the contracting authority will verify whether the requirements of the individual items of the technical requirements contained in the annexes to the tender specification have been met. The contractor must prove in the tender the equivalence of the equipment or systems offered. The burden of proving equivalence shall be on the Contractor. The contracting authority will not recognise equivalent solutions if they are worse than the minimum quality, functional, technical and technological requirements indicated in the annexes to the ToR.
