The Ordering Party shall inform the Contractor about the exercise of the option right via e-mail (to the e-mail address indicated in the contract) or via the postal operator to the correspondence address indicated in the contract). Delivery under the option will be carried out under the same conditions as in the case of performance of the basic contract described in detail in Part III of the tender specification – the draft provisions of the contract. In the event that the Contracting Authority does not exercise the option right or does not exercise the option right to a full extent, the Contractor shall have no claim against the Contracting Authority in this respect. The contracting authority also reserves the right to order products not included in the estimated list of products due to circumstances that the contracting authority was not able to foresee at the time of describing the subject of the contract: e.g. amendment of the Act on nutrition in educational institutions, the need to use a specialized diet. 3. The Contractor undertakes to deliver goods that meet the requirements set out in the current legal regulations, i.e. released for free circulation in Poland and have the necessary certificates, attestations, HDI, etc. documents for sanitary records provided for by law and takes full responsibility in this regard. These documents shall be delivered by the Contractor to the Ordering Party together with each delivery. The detailed terms of delivery are set out in the draft provisions of the contract forming part III of the ToR 4. By the term ‘type’ or ‘equivalent’, the Ordering Party understands products with non-inferior quality parameters, having the same organoleptic qualities (taste, smell, colour, consistency) and containing in their composition at least the same raw materials used for production as the articles specified by the Ordering Party. If equivalent articles are included in the offer, it is necessary to attach documents confirming their parameters. It shall be the responsibility of the Contractor to prove that the article offered is equivalent to the articles specified by the Contracting Authority. 5. The capacity and weight of the packaging may not differ from the capacity and weight suggested by the Ordering Party. During the execution of the order, the Ordering Party allows for the possibility of changing the capacity and weight of food products in the event of withdrawal from the market of a given product with a given weight and in the event of its difficult availability in trade in goods. Any changes in the weights and capacity of the products require the consent of the Ordering Party. If the ordering party agrees, the unit prices of individual products will be calculated in proportion to the weight given. 6. In the event of a product being withdrawn from the market during the performance of the contract, the Contractor shall offer an equivalent product and quote a unit price for the product offered. This change requires the consent of the Ordering Party. 7. During the performance of the contract, products whose unit of measurement is expressed in kilograms or in litres may be converted by the contractor into the price of packaging suggested by the Ordering Party. 8. Estimated list of products covered by the contract:
