What the buyer is looking for
The subject of the contract is insurance of vehicles owned or used by the Ordering Party in the scope of: a) compulsory insurance against civil liability in respect of the use of motor vehicles (OC) b) insurance against civil liability in respect of the use of motor vehicles in countries covered by the Green Card system (ZK), c) autocasco insurance (AC), d) Assistance insurance (ASS), e) accident insurance for vehicle users and passengers (NNW). A detailed description of the subject-matter of the contract and other information relevant to the preparation of the tender are contained in Annexes 4, 8 and 9 to the tender specification. Pursuant to Article 441 of the Public Procurement Act, the contracting authority reserves the right to unilaterally extend the scope of the contract as part of the exercise of the right of option. The contracting authority does not divide the contract into…

… lots. Thus, the contracting authority does not allow the submission of partial tenders referred to in Article 7(15) of the Public Procurement Act. Justification for not splitting the contract into lots: The contracting authority informs that it does not divide the contract into lots in the procedure for the procurement of insurance services for OC, AC, ASS and NNW vehicles, as this is not in the interest of the contracting authority. The division of responsibility for the insurance services provided into two or more entities will be only illusory due to the homogeneity of the entire contract. In addition, dividing the contract into lots may make it difficult to obtain full insurance coverage or significantly increase its cost. The division of the contract could make it more difficult to determine the liability of a particular insurer (in the event that the contract is awarded to different insurers), especially since insurances could be mutually exclusive, which could consequently lead to the contracting authority not obtaining compensation. In addition, contractors can only comprehensively present the real and adequate cost of insurance protection to the state of the market by diversifying their risk between the insurances indicated in the tender specifications.
